1 A bill to be entitled
2 An act relating to motor vehicle repair shops;
3 amending s. 559.904, F.S.; requiring applicants
4 for registration to furnish proof of certain
5 liability insurance; providing that failure to
6 maintain such insurance is grounds for denial,
7 revocation, or refusal to renew a registration;
8 providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:
11
12 Section 1. Subsection (10) of section 559.904, Florida
13 Statutes, is amended, and subsection (13) is added to that
14 section, to read:
15 559.904 Motor vehicle repair shop registration;
16 application; exemption.--
17 (10) The department may deny, revoke, or refuse to
18 renew the registration of a motor vehicle repair shop based
19 upon a determination that the motor vehicle repair shop, or
20 any of its directors, officers, owners, or general partners:
21 (a) Have failed to meet the requirements for
22 registration as provided in this part;
23 (b) Have not satisfied a civil fine, administrative
24 fine, or other penalty arising out of any administrative or
25 enforcement action brought by any governmental agency based
26 upon conduct involving fraud, dishonest dealing, or any
27 violation of this part;
28 (c) Have had against them any civil, criminal, or
29 administrative adjudication in any jurisdiction, based upon
30 conduct involving fraud, dishonest dealing, or any violation
31 of this part; or

1 (d) Have had a judgment entered against them in any
2 action brought by the department or the state attorney
3 pursuant to ss. 501.201-501.213 or this part; or.
4 (e) Have failed to maintain in force the insurance
5 required under subsection (13).
6 (13) Each initial or renewal applicant for
7 registration under this section must furnish the department
8 with evidence that the applicant has obtained liability
9 insurance in the amount of $1 million on repairs performed by
10 the motor vehicle repair shop.
11 Section 2. This act shall take effect July 1, 2005.

14 SENATE SUMMARY
15 Requires motor vehicle repair shops to have liability
insurance in the amount of $1 million for repairs they
16 perform as a condition of registration and makes failure
to maintain such insurance grounds for denying, revoking,
17 or refusing to renew the registration.
