10on certain contracts and written documents; amending s.
11409.2558, F.S.; requiring the Department of Revenue to
12make efforts to locate persons to whom collections or
13refunds are owed prior to determining a collection or
14refund to be undistributable; providing for disclosure of
15information on the Internet; providing for protection of
16the privacy of persons named in the database; providing an
17effective date.

19Be It Enacted by the Legislature of the State of Florida:
20
21     Section 1.  Subsection (11) is added to section 409.1671,
22Florida Statutes, to read:
23     409.1671  Foster care and related services;
24privatization.--
25     (11)  A lead community-based provider and its
26subcontractors are exempt from including in written contracts
27and other written documents the statement "sponsored by the
28State of Florida" or the logo of the Department of Children and
29Family Services, otherwise required in s. 286.25, unless the
30provider or subcontractor receives more than 35 percent of its
31total funding from the state.
32     Section 2.  Paragraph (a) of subsection (2) of section
33409.2558, Florida Statutes, is amended to read:
34     409.2558  Support distribution and disbursement.--
35     (2)  UNDISTRIBUTABLE COLLECTIONS.--
36     (a)  The department shall establish by rule the method for
37determining a collection or refund to a noncustodial parent to
38be undistributable to the final intended recipient. Before
39determining a collection or refund to be undistributable, the
40department shall make reasonable efforts to locate persons to
41whom collections or refunds are owed so that payment can be
42made. Location efforts may include disclosure through a
43searchable database of the names of obligees, obligors, and
44depository account numbers on the Internet employing appropriate
45safeguards to protect the privacy of the persons named in the
46database.
47     Section 3.  This act shall take effect July 1, 2005.
