11  Senator Campbell moved the following amendment:

13         Senate Amendment (with title amendment) 
14         On page 10, between lines 12 and 13,
15  
16  and insert:  
17         Section 5.  Section 499.036, Florida Statutes, is
18  created to read:
19         499.036  Sale, distribution, or transfer of certain
20  temporary tattoos or products that contain
21  paraphenylendiamine; penalties; authority for enforcement.--
22         (1)  It is unlawful to sell, deliver, or give to a
23  person any compound, liquid, or chemical containing
24  paraphenylendiamine unless it is in a form that is approved
25  for use by the U.S. Food and Drug Administration.
26         (2)  It is also unlawful to sell, deliver, or give to a
27  person a temporary tattoo that contains any product that is
28  not approved for use by the U.S. Food and Drug Administration.
29         (3)  On the first violation of this section, the
30  department may issue a warning according to s. 499.071, if the
31  violation has not caused temporary or permanent physical or

 1  mental injury to the user.
 2         (4)  If any violation of this section has caused
 3  temporary or permanent physical or mental injury to the user,
 4  the department may, pursuant to chapter 120, impose fines
 5  according to s. 499.066 and may report any violation to the
 6  appropriate state attorney for prosecution.
 7         (5)  The Department of Health shall adopt rules to
 8  implement this section.

17  insert:
