12 (Peaden) recommended the following amendment:

14 Senate Amendment (with title amendment)
15 On page 9, between lines 25 and 26,
16
17 insert:
18 Section 4. Notwithstanding any other provisions of law
19 to the contrary, the Agency for Health Care Administration may
20 not:
21 (1) Review or use any violation or alleged violation
22 of section 499.021(6), Florida Statutes, or any rules adopted
23 under that section, as a ground for denying or withholding any
24 payment of a Medicaid reimbursement to a pharmacy licensed
25 under chapter 465, Florida Statutes; or
26 (2) Review or use compliance with section 499.021(6),
27 Florida Statutes, or any rules adopted under that section, as
28 the subject of any audit of Medicaid-related records held by a
29 pharmacy licensed under chapter 465, Florida Statutes.

6 prohibiting the Agency for Health Care
7 Administration from reviewing or using certain
8 violations relating to recordkeeping for
9 prescription drugs to deny or withhold Medicaid
10 payments to pharmacies or to audit the records
11 of such pharmacies;
