8 exemption under the Open Government Sunset
9 Review Act; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Subsection (6) of section 1009.981, Florida
14 Statutes, is amended to read:
15 1009.981 Florida College Savings Program.--
16 (6) CONFIDENTIALITY OF ACCOUNT
17 INFORMATION.--Information that identifies the benefactors or
18 the designated beneficiary of any account initiated under this
19 section is and information regarding individual account
20 activities conducted through the savings program established
21 in this section are confidential and exempt from the
22 provisions of s. 119.07(1) and s. 24(a), Art. I of the State
23 Constitution. However, the board may authorize the release of
24 such information to a community college, college, or
25 university in which a designated beneficiary may enroll or is
26 enrolled. Community colleges, colleges, and universities shall
27 maintain the confidentiality of such information. This
28 subsection is subject to the Open Government Sunset Review Act
29 of 1995 in accordance with s. 119.15, and shall stand repealed
30 on October 2, 2005, unless reviewed and saved from repeal
31 through reenactment by the Legislature.

6 Removes college prepaid exemption from bill as it was not
certified as part of the Open Government Sunset Review by
7 Statutory Revision.
8 Removes exemption for individual account activities as the
exemption protects the identity of the benefactor and
9 beneficiary.
