12  (Sebesta) recommended the following amendment:

14         Senate Amendment 
15         On page 14, line 11, delete that line
16  
17  and insert:  agreement without the consent of the franchisee,
18  any existing territorial agreement between electric utilities
19  or public utilities as defined in chapter 366, or the
20  jurisdiction of the Public Service Commission under s. 366.04
21  to resolve a territorial dispute involving electric utilities
22  or public utilities in accordance with the criteria set out in
23  that section. In addition, an interlocal agreement entered
24  into under this section has no effect in a territorial dispute
25  proceeding before the Public Service Commission. A
