  1              Senate Concurrent Resolution No. ____

  2         A concurrent resolution ratifying the proposed

  3         amendment to the Constitution of the United

  4         States relating to equal rights for men and

  5         women.

  6  

  7         WHEREAS, three years after women won the right to vote,

  8  the Equal Rights Amendment to the United States Constitution,

  9  authored by Alice Paul, head of the National Women's Party,

10  was introduced in Congress by Senator Curtis and

11  Representative Anthony, both Republicans, and

12         WHEREAS, on March 22, 1972, the proposed Amendment to

13  the United States Constitution was sent to the States for

14  ratification, and

15         WHEREAS, the Equal Rights Amendment to the United

16  States Constitution states:

17         "SECTION 1.  Equality of rights under the law shall not

18  be denied or abridged by the United States or by any State on

19  account of sex.

20         "SECTION 2.  The Congress shall have the power to

21  enforce, by appropriate legislation, the provisions of this

22  article.

23         "SECTION 3.  This amendment shall take effect two years

24  after the date of ratification." and

25         WHEREAS, Congress placed a deadline of June 30, 1982,

26  on the ratification process and thirty-five states ratified

27  the proposed Amendment before the deadline, and

28         WHEREAS, Congress may not have the constitutional

29  authority to place a deadline on the ratification process, and

30         WHEREAS, Article V of the United States Constitution

31  allows the Legislature of the State of Florida to ratify this

 1  proposed Amendment to the Constitution of the United States,

 2  and

 3         WHEREAS, the Legislature of the State of Florida finds

 4  that the proposed Amendment is meaningful and needed as part

 5  of the United States Constitution and that the present

 6  political, social, and economic conditions are the same or are

 7  even more demanding as when the proposed Amendment was first

 8  submitted for adoption, NOW, THEREFORE,

 9  

10  Be It Resolved by the Senate of the State of Florida, the

11  House of Representatives Concurring:

12  

13         That the proposed amendment to the Constitution of the

14  United States set forth below is ratified by the Legislature

15  of the State of Florida.

16                          "Article ____

17         "SECTION 1.  Equality of rights under the law shall not

18  be denied or abridged by the United States or by any State on

19  account of sex.

20         "SECTION 2.  The Congress shall have the power to

21  enforce, by appropriate legislation, the provisions of this

22  article.

23         "SECTION 3.  This amendment shall take effect two years

24  after the date of ratification."

25         BE IT FURTHER RESOLVED, that certified copies of the

26  foregoing preamble and resolution be immediately forwarded by

27  the Secretary of State of the State of Florida, under the

28  great seal, to the President of the United States, the

29  Secretary of State of the United States, the President of the

30  Senate of the United States, the Speaker of the House of
