11  The Committee on Health Care (Saunders) recommended the
12  following amendment:

14         Senate Amendment (with title amendment) 
15         On page 1, line 25, through
16            page 2, line 8, delete those lines
17  
18  and insert:  
19         Section 1.  Section 456.50, Florida Statutes, is
20  created to read:
21         456.50  Prohibition of license after repeated medical
22  malpractice.--
23         (1)  For purposes of implementing s. 26, Art. X of the
24  State Constitution, the board shall not license or continue to
25  license a medical doctor found to have committed repeated
26  medical malpractice, the finding of which was based upon clear
27  and convincing evidence. In order to rely on an incident of
28  medical malpractice to determine whether a license must be
29  denied or revoked under this section, if the facts supporting
30  the finding of the incident of medical malpractice were
31  determined on a standard less stringent than clear and

X of the State 13 Constitution; prohibiting the Board of Medicine 14 and the Board of Osteopathic Medicine, 15 respectively, from licensing or continuing to 16 license physicians or osteopathic physicians 17 who have committed repeated medical 18 malpractice, as defined; prescribing the 19 standard under which a finding of medical 20 malpractice must be made in order to be 21 considered for purposes of denial or revocation 22 of licensure; providing duties of the 23 respective boards; limiting the application of 24 the prohibition on licensure of physicians and 25 osteopathic physicians to incidents of medical 26 malpractice occurring on or after a specified 27 28 29 30 31 2 7:00 PM 03/14/05 s0940c-he37-b02
