1 A bill to be entitled
2 An act relating to alcoholic beverage licenses;
3 amending s. 565.02, F.S.; authorizing the
4 issuance of a nonquota license to certain
5 sporting and recreational lodges; requiring
6 that serving hours conform to certain local
7 ordinances; providing rulemaking authority;
8 providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:
11
12 Section 1. Present subsection (12) of section 565.02,
13 Florida Statutes, is redesignated as subsection (13), and new
14 subsections (12) and (14) are added to that section to read:
15 565.02 License fees; vendors; clubs; caterers; and
16 others.--
17 (12) A sporting and recreational lodge complex may
18 obtain, upon the payment of appropriate fees, a license for
19 on-premises consumption of alcoholic beverages not subject to
20 any quota or limitation if the complex:
21 (a) Comprises at least 10,000 acres of land;
22 (b) Has indoor sleeping facilities with at least 12
23 rooms;
24 (c) Has a restaurant that seats at least 25 persons;
25 and
26 (d) Has been in continuous existence for at least 2
27 years.

29 The enclosed area within the complex shall be considered the
30 licensed premises upon the payment of the fee. Except as
31 otherwise provided in this subsection, entities licensed under

1 this subsection are vendors licensed to sell alcoholic
2 beverages by the drink and are subject to all provisions
3 relating to such vendors. However, notwithstanding any
4 provision of law, a complex may only sell or provide alcoholic
5 beverages in a manner that is consistent with any local
6 ordinances of a governing body having jurisdiction over the
7 location of the complex.
8 (14) The division may adopt rules governing the
9 designation process, criteria for qualification, and other
10 rules necessary to administer this section.
11 Section 2. This act shall take effect July 1, 2005.

14 SENATE SUMMARY
15 Authorizes the issuance of a nonquota liquor license to
certain sporting and recreational lodges. Requires that a
16 licensed complex sell or serve alcoholic beverages in a
manner consistent with any local ordinance of a governing
17 body having jurisdiction over the location of the
complex. Provides rulemaking authority for the Division
18 of Alcoholic Beverages and Tobacco of the Department of
Business and Professional Regulation.
