3 | 330.30, F.S.; prohibiting the Department of Transportation |
4 | from renewing or reissuing licenses to certain general |
5 | aviation airports that fail to develop a security plan; |
6 | requiring that the plans be consistent with certain |
7 | published guidelines; providing for review and approval of |
8 | such plans by the Department of Law Enforcement; requiring |
9 | periodic update of the plans; providing an effective date. |

11 | Be It Enacted by the Legislature of the State of Florida: |
12 |
|
13 | Section 1. Paragraph (e) of subsection (2) of section |
14 | 330.30, Florida Statutes, is amended, and paragraph (f) is added |
15 | to said subsection, to read: |
16 | 330.30 Approval of airport sites; registration and |
17 | licensure of airports.-- |
18 | (2) LICENSES AND REGISTRATIONS; REQUIREMENTS, RENEWAL, |
19 | REVOCATION.-- |
20 | (e) The department may revoke, or refuse to allow or |
21 | issue, any airport registration or recertification, or any |
22 | license or license renewal, if it determines: |
23 | 1. That the site has been abandoned as an airport; |
24 | 2. That the airport does not comply with the conditions of |
25 | the license, license renewal, or site approval; or |
26 | 3. That the airport has become either unsafe or unusable |
27 | for flight operation due to physical or legal changes in |
28 | conditions that were the subject of approval; or. |
29 | 4. That an airport required to file or update a security |
30 | plan pursuant to paragraph (f) has failed to do so. |
31 | (f)1. After initial licensure or registration, a license |
32 | or registration of a publicly or privately owned general |
33 | aviation airport that is open to the public, that has at least |
34 | one runway greater than 4,999 feet in length, and that does not |
35 | host scheduled passenger-carrying commercial service operations |
36 | regulated under 14 C.F.R. Part 139 shall not be renewed, |
37 | reissued, or recertified unless an approved security plan has |
38 | been filed with the department, except when the department |
39 | determines that the airport is working in good faith toward |
40 | completion and filing of the plan. |
41 | 2. Security plans required by this paragraph must be |
42 | developed in accordance with the 2004 Security Guidelines for |
43 | General Aviation Airports published by the United States |
44 | Department of Homeland Security Transportation Security |
45 | Administration or the 2004 Security Planning for General |
46 | Aviation Airports guidelines published by the Florida Airports |
47 | Council, and shall be reviewed and approved by the Department of |
48 | Law Enforcement prior to filing. |
49 | 3. The Department of Law Enforcement shall not approve a |
50 | security plan unless it is consistent with the Transportation |
51 | Security Administration's or Florida Airports Council's |
52 | guidelines and it has determined that the plan has been |
53 | developed appropriately to meet the particular security needs of |
54 | the airport for which it was created. Upon approval of the |
55 | security plan, the Department of Law Enforcement shall notify |
56 | the department of such approval. |
57 | 4. An airport required to file a security plan pursuant to |
58 | this paragraph shall update its plan at least once every 2 years |
59 | after the initial filing date and file the updated plan with the |
60 | department. The Department of Law Enforcement shall review the |
61 | updated plan prior to filing to determine whether it has been |
62 | updated appropriately to meet the particular security needs of |
63 | the airport and shall report its determination to the |
64 | department. No renewal license or registration recertification |
65 | shall be issued to the airport, or acknowledged by the |
66 | department, unless the department determines that the airport |
67 | has updated the security plan or is working in good faith to |
68 | update it. |
69 | Section 2. This act shall take effect October 1, 2005. |
