A bill to be entitled
2An act relating to the regulation of airports; amending s.
3330.30, F.S.; prohibiting the Department of Transportation
4from renewing or reissuing licenses to certain general
5aviation airports that fail to develop a security plan;
6requiring that the plans be consistent with certain
7published guidelines; providing for review and approval of
8such plans by the Department of Law Enforcement; requiring
9periodic update of the plans; providing an effective date.

11Be It Enacted by the Legislature of the State of Florida:
12
13     Section 1.  Paragraph (e) of subsection (2) of section
14330.30, Florida Statutes, is amended, and paragraph (f) is added
15to said subsection, to read:
16     330.30  Approval of airport sites; registration and
17licensure of airports.--
18     (2)  LICENSES AND REGISTRATIONS; REQUIREMENTS, RENEWAL,
19REVOCATION.--
20     (e)  The department may revoke, or refuse to allow or
21issue, any airport registration or recertification, or any
22license or license renewal, if it determines:
23     1.  That the site has been abandoned as an airport;
24     2.  That the airport does not comply with the conditions of
25the license, license renewal, or site approval; or
26     3.  That the airport has become either unsafe or unusable
27for flight operation due to physical or legal changes in
28conditions that were the subject of approval; or.
29     4.  That an airport required to file or update a security
30plan pursuant to paragraph (f) has failed to do so.
31     (f)1.  After initial licensure or registration, a license
32or registration of a publicly or privately owned general
33aviation airport that is open to the public, that has at least
34one runway greater than 4,999 feet in length, and that does not
35host scheduled passenger-carrying commercial service operations
36regulated under 14 C.F.R. Part 139 shall not be renewed,
37reissued, or recertified unless an approved security plan has
38been filed with the department, except when the department
39determines that the airport is working in good faith toward
40completion and filing of the plan.
41     2.  Security plans required by this paragraph must be
42developed in accordance with the 2004 Security Guidelines for
43General Aviation Airports published by the United States
44Department of Homeland Security Transportation Security
45Administration or the 2004 Security Planning for General
46Aviation Airports guidelines published by the Florida Airports
47Council, and shall be reviewed and approved by the Department of
48Law Enforcement prior to filing.
49     3.  The Department of Law Enforcement shall not approve a
50security plan unless it is consistent with the Transportation
51Security Administration's or Florida Airports Council's
52guidelines and it has determined that the plan has been
53developed appropriately to meet the particular security needs of
54the airport for which it was created. Upon approval of the
55security plan, the Department of Law Enforcement shall notify
56the department of such approval.
57     4.  An airport required to file a security plan pursuant to
58this paragraph shall update its plan at least once every 2 years
59after the initial filing date and file the updated plan with the
60department. The Department of Law Enforcement shall review the
61updated plan prior to filing to determine whether it has been
62updated appropriately to meet the particular security needs of
63the airport and shall report its determination to the
64department. No renewal license or registration recertification
65shall be issued to the airport, or acknowledged by the
66department, unless the department determines that the airport
67has updated the security plan or is working in good faith to
68update it.
69     Section 2.  This act shall take effect October 1, 2005.
