A bill to be entitled
2An act relating to the regulation of airports; amending s.
3330.30, F.S.; prohibiting the Department of Transportation
4from renewing or reissuing licenses to certain general
5aviation airports that fail to develop a security plan;
6requiring that the plans be consistent with certain
7published guidelines; requiring certain information in the
8plans to be submitted to the Department of Law
9Enforcement; requiring periodic update of the plans;
10providing an effective date.

12Be It Enacted by the Legislature of the State of Florida:
13
14     Section 1.  Paragraph (e) of subsection (2) of section
15330.30, Florida Statutes, is amended, and paragraph (f) is added
16to said subsection, to read:
17     330.30  Approval of airport sites; registration and
18licensure of airports.--
19     (2)  LICENSES AND REGISTRATIONS; REQUIREMENTS, RENEWAL,
20REVOCATION.--
21     (e)  The department may revoke, or refuse to allow or
22issue, any airport registration or recertification, or any
23license or license renewal, if it determines:
24     1.  That the site has been abandoned as an airport;
25     2.  That the airport does not comply with the conditions of
26the license, license renewal, or site approval; or
27     3.  That the airport has become either unsafe or unusable
28for flight operation due to physical or legal changes in
29conditions that were the subject of approval; or.
30     4.  That an airport required to file or update a security
31plan pursuant to paragraph (f) has failed to do so.
32     (f)1.  After initial licensure, a license of a publicly or
33privately owned general aviation airport that is open to the
34public, that has at least one runway greater than 4,999 feet in
35length, and that does not host scheduled passenger-carrying
36commercial service operations regulated under 14 C.F.R. Part 139
37shall not be renewed or reissued unless an approved security
38plan has been filed with the department, except when the
39department determines that the airport is working in good faith
40toward completion and filing of the plan.
41     2.  Security plans required by this paragraph must be
42developed in accordance with the 2004 Security Planning for
43General Aviation Airports guidelines published by the Florida
44Airports Council. Certain administrative data from the approved
45security plan shall be submitted to the Department of Law
46Enforcement, in a format prescribed by the Department of Law
47Enforcement, for use in protecting critical infrastructure of
48the state.
49     3.  The department shall not approve a security plan for
50filing unless it is consistent with Florida Airports Council's
51guidelines and it has determined that the plan has been
52developed appropriately to meet the particular security needs of
53the airport for which it was created.
54     4.  An airport required to file a security plan pursuant to
55this paragraph shall update its plan at least once every 2 years
56after the initial filing date and file the updated plan with the
57department. The department shall review the updated plan prior
58to approving it for filing to determine whether it has been
59updated appropriately to meet the particular security needs of
60the airport. No renewal license shall be issued to the airport
61unless the department approves the updated security plan or
62determines that the airport is working in good faith to update
63it.
64     Section 2.  This act shall take effect October 1, 2005.
