14 Senate Amendment (with title amendment)
15 On page 1, lines 22-26, delete those lines
16
17 and insert:
18 (e) Statement by deceased or ill declarant similar to
19 one previously admitted.--In an action or proceeding brought
20 against the personal representative, heir at law, assignee,
21 legatee, devisee, or survivor of a deceased person, or against
22 a trustee of a trust created by a deceased person, or against
23 the assignee, committee, or guardian of a mentally incompetent
24 person, when a declarant is unavailable as provided in
25 paragraph (1)(d), a written or oral statement made regarding
26 the same subject matter as another statement made by the
27 declarant that has previously been offered by an adverse party
28 and admitted in evidence.
