10s. 812.0147, F.S.; providing that it is a second-degree
11felony to alter, possess, or use a fifth wheel to commit
12or attempt to commit theft; providing criminal penalties;
13amending s. 812.155, F.S.; deleting a provision specifying
14that the prohibition against obtaining personal property
15or equipment with intent to defraud does not apply to a
16rental-purchase agreement unless the rental store retains
17title to the property or equipment throughout the period
18of the rental-purchase agreement; amending s. 921.0022,
19F.S.; classifying the offense of stealing a semitrailer
20deployed by a law enforcement officer under the offense
21severity ranking chart of the Criminal Punishment Code;
22reenacting s. 985.227(1)(a), F.S., relating to prosecution
23of juveniles as adults, in order to incorporate the
24amendment to s. 812.014, F.S., in a reference thereto;
25providing an effective date.

27Be It Enacted by the Legislature of the State of Florida:
28
29     Section 1.  Paragraph (a) of subsection (2) of section
30812.014, Florida Statutes, is amended to read:
31     812.014  Theft.--
32     (2)(a)1.  If the property stolen is valued at $100,000 or
33more or is a semitrailer that was deployed by a law enforcement
34officer; or
35     2.  If the property stolen is cargo valued at $50,000 or
36more that has entered the stream of interstate or intrastate
37commerce from the shipper's loading platform to the consignee's
38receiving dock; or
39     3.  If the offender commits any grand theft and:
40     a.  In the course of committing the offense the offender
41uses a motor vehicle as an instrumentality, other than merely as
42a getaway vehicle, to assist in committing the offense and
43thereby damages the real property of another; or
44     b.  In the course of committing the offense the offender
45causes damage to the real or personal property of another in
46excess of $1,000,

48the offender commits grand theft in the first degree, punishable
49as a felony of the first degree, as provided in s. 775.082, s.
50775.083, or s. 775.084.
51     Section 2.  Section 812.0147, Florida Statutes, is created
52to read:
53     812.0147  Unlawful possession or use of a fifth wheel.--
54     (1)  A person may not modify, alter, or attempt to alter,
55and if altered, sell, possess, offer for sale, move, or cause to
56be moved onto the highways of this state, a device known as a
57fifth wheel with the intent to use the fifth wheel to commit or
58attempt to commit theft. As used in this section, the term
59"fifth wheel" applies only to a fifth wheel on a semitrailer.
60     (2)  Any person who violates subsection (1) commits a
61felony of the second degree, punishable as provided in s.
62775.082, s. 775.083, or s. 775.084.
63     Section 3.  Subsection (7) of section 812.155, Florida
64Statutes, is amended to read:
65     812.155  Hiring, leasing, or obtaining personal property or
66equipment with the intent to defraud; failing to return hired or
67leased personal property or equipment; rules of evidence.--
68     (7)  EXCLUSION OF RENTAL-PURCHASE AGREEMENTS.--This section
69does not apply to personal property or equipment that is the
70subject of a rental-purchase agreement that permits the lessee
71to acquire ownership of the personal property or equipment
72unless the rental store retains title to the personal property
73or equipment throughout the rental-purchase agreement period.
74     Section 4.  Paragraph (g) of subsection (3) of section
75921.0022, Florida Statutes, is amended to read:

178filing of an information in the criminal division of the circuit
179court; discretionary criteria; mandatory criteria.--
180     (1)  DISCRETIONARY DIRECT FILE; CRITERIA.--
181     (a)  With respect to any child who was 14 or 15 years of
182age at the time the alleged offense was committed, the state
183attorney may file an information when in the state attorney's
184judgment and discretion the public interest requires that adult
185sanctions be considered or imposed and when the offense charged
186is for the commission of, attempt to commit, or conspiracy to
187commit:
188     1.  Arson;
189     2.  Sexual battery;
190     3.  Robbery;
191     4.  Kidnapping;
192     5.  Aggravated child abuse;
193     6.  Aggravated assault;
194     7.  Aggravated stalking;
195     8.  Murder;
