  1                      A bill to be entitled

  2         An act relating to specialty license plates;

  3         amending ss. 320.08056 and 320.08058, F.S.;

  4         creating the NASCAR license plate under certain

  5         circumstances; providing an annual use fee;

  6         providing for the distribution of annual use

  7         fees received from the sale of such plates;

  8         providing a conditional effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11  

12         Section 1.  Paragraph (eee) is added to subsection (4)

13  of section 320.08056, Florida Statutes, to read:

14         320.08056  Specialty license plates.--

15         (4)  The following license plate annual use fees shall

16  be collected for the appropriate specialty license plates:

17         (eee)  NASCAR license plate, $25.

18         Section 2.  Subsection (57) is added to section

19  320.08058, Florida Statutes, to read:

20         320.08058  Specialty license plates.--

21         (57)  NASCAR LICENSE PLATES.--

22         (a)  Upon the NASCAR Hall of Fame, Inc., meeting the

23  requirements of s. 320.08053, the department shall develop a

24  NASCAR license plate as provided in this subsection. NASCAR

25  license plates must bear the colors and design approved by the

26  department. The word "Florida" must appear at the top of the

27  plate, and the term "NASCAR" must appear at the bottom of the

28  plate. The NASCAR Hall of Fame, after consultation with the

29  National Association for Stock Car Auto Racing, Inc., and the

30  International Speedway Corporation, may submit a sample plate

31  for consideration by the department.

 1         (b)  The annual use fees shall be distributed to the

 2  NASCAR Hall of Fame, Inc., to be used exclusively for the

 3  construction and operation of the NASCAR Hall of Fame.

 4         Section 3.  This act shall take effect 30 days after

 5  the City of Daytona Beach is designated by the National

 6  Association for Stock Car Auto Racing, Inc., as the site for

 7  the official NASCAR Hall of Fame facility.

12  This CS specifies the NASCAR Hall of Fame, Inc., may meet the
    requirements to create the license plate, as opposed to an
13  un-named organization and also is designated to receive the
    monies generated by sales of the NASCAR license plate.

    In addition, the CS deletes redundant language regarding
15  authorization of the license plate being contingent upon the
    City of Daytona Beach being designated by the National
16  Association for Stock Car Auto Racing, Inc., as the site for
    the official NASCAR Hall of Fame.
