11 The Committee on Health Care (Atwater) recommended the
12 following amendment:

14 Senate Amendment (with title amendment)
15 On page 3, line 19 through page 5, line 14, delete
16 those lines and insert:
17 Section 1. Subsection (9) of section 409.911, Florida
18 Statutes, is amended and subsection (10) is added to that
19 section to read:
20 409.911 Disproportionate share program.--Subject to
21 specific allocations established within the General
22 Appropriations Act and any limitations established pursuant to
23 chapter 216, the agency shall distribute, pursuant to this
24 section, moneys to hospitals providing a disproportionate
25 share of Medicaid or charity care services by making quarterly
26 Medicaid payments as required. Notwithstanding the provisions
27 of s. 409.915, counties are exempt from contributing toward
28 the cost of this special reimbursement for hospitals serving a
29 disproportionate share of low-income patients.
30 (9) The Agency for Health Care Administration shall
31 create a Medicaid Disproportionate Share Council.

1 (a) The purpose of the council is to study and make
2 recommendations regarding:
3 1. The formula for the regular disproportionate share
4 program and alternative financing options.
5 2. Enhanced Medicaid funding through the Special
6 Medicaid Payment program.
7 3. The federal status of the upper-payment-limit
8 funding option and how this option may be used to promote
9 health care initiatives determined by the council to be state
10 health care priorities.
11 4. The development of the low income pool plan as
12 required by the federal Centers for Medicare and Medicaid
13 Services using the objectives established in s.
14 409.91211(1)(c).
15 (b) The council shall include representatives of the
16 Executive Office of the Governor and of the agency;
17 representatives from teaching, public, private nonprofit,
18 private for-profit, and family practice teaching hospitals;
19 and representatives from other groups as needed. The agency
20 must ensure that there is fair representation of each group
21 specified in this paragraph.
22 (c) The council shall submit its findings and
23 recommendations to the Governor and the Legislature no later
24 than March 1 February 1 of each year.
25 (d) This subsection shall stand repealed June 30, 2006,
26 unless reviewed and saved from repeal through reenactment by
27 the Legislature.
28 (10) The Agency for Health Care Administration shall
29 create a Medicaid Low-Income Pool Council by July 1, 2006. The
30 Low-Income Pool Council shall consist of 17 members, including
31 three representatives of statutory teaching hospitals, three

1 representatives of public hospitals, three representatives of
2 nonprofit hospitals, three representatives of for-profit
3 hospitals, two representatives of rural hospitals, two
4 representatives of units of local government which contribute
5 funding, and one representative of the Department of Health.
6 The council shall:
7 (a) Make recommendations on the financing of the
8 low-income pool and the disproportionate share hospital
9 program and the distribution of their funds.
10 (b) Advise the Agency for Health Care Administration on
11 the development of the low-income pool plan required by the
12 federal Centers for Medicare and Medicaid Services pursuant to
13 the Medicaid reform waiver.
14 (c) Advise the Agency for Health Care Administration on
15 the distribution of hospital funds used to adjust inpatient
16 hospital rates, rebase rates, or otherwise exempt hospitals
17 from reimbursement limits as financed by intergovernmental
18 transfers.
19 (d) Submit its findings and recommendations to the
20 Governor and the Legislature no later than February 1 of each
21 year.
