12 following amendment:

15 On page 36, between lines 21 and 22,

17 insert:
18 (7) The Office of Insurance Regulation shall conduct an
19 annual review of the Medicaid managed care pilot program's
20 risk-adjusted rate setting methodology as developed by the
21 agency. The Office of Insurance Regulation shall contract with
22 an independent actuary firm to assist in the annual review and
23 to provide technical expertise.
24 (a) After reviewing the actuarial analysis provided by
25 the agency, the Office of Insurance Regulation shall make
26 advisory recommendations to the Governor and the Legislature
27 regarding:
28 1. The methodology adopted by the agency for
29 risk-adjusted rates.
30 2. The risk-adjusted rate for each Medicaid eligibility
31 category in the demonstration program.

1 3. Administrative and implementation issues regarding
2 the use of risk-adjusted rates, including, but not limited to,
3 cost, simplicity, client privacy, data accuracy, and data
4 exchange.
5 (b) For each annual review, the Office of Insurance
6 Regulation shall solicit input concerning the agency's rate
7 setting methodology from the Florida Association of Health
8 Plans, the Florida Hospital Association, the Florida Medical
9 Association, Medicaid recipient advocacy groups, and other
10 stakeholder representatives as necessary to obtain a broad
11 representation of perspectives on the effects of the agency's
12 adopted rate setting methodology and recommendations on
13 possible modifications to the methodology.
14 (c) The Office of Insurance Regulation shall submit its
15 findings and advisory recommendations to the Governor and the
16 Legislature no later than February 1 of each year for
17 consideration by the Legislature for inclusion in the General
18 Appropriations Act.
