11  The Committee on Ways and Means (Miller) recommended the
12  following amendment:
13  
14         Senate Amendment (with title amendment) 
15         On page 36, line 18, through
16            page 37, line 3, delete those lines
17  
18  and insert:  submitted for consideration by the Legislature.
19  The agency may implement the waiver and special terms and
20  conditions numbered 11-W-00206/4, as approved by the federal
21  Centers for Medicare and Medicaid Services on October 19,
22  2005. If the agency seeks approval by the Federal Government
23  of any modifications to these special terms and conditions,
24  the agency must provide written notification of its intent to
25  modify these terms and conditions to the President of the
26  Senate and the Speaker of the House of Representatives at
27  least 15 days before submitting the modifications to the
28  Federal Government for consideration. The notification must
29  identify all modifications being pursued and the reason the
30  modifications are needed. Upon receiving federal approval of
31  any modifications to the special terms and conditions, the

 1  agency shall provide a report to the Legislature describing
 2  the federally approved modifications to the special terms and
 3  conditions within 7 days after approval by the Federal
 4  Government. The Agency for Health Care Administration may not
 5  implement any modifications to the special terms and
 6  conditions until such modifications have been approved by the
 7  Legislature.

12         On page 2, line 29, after the semicolon,

14  insert:
15         prohibiting the agency from modifying any
16         special terms and conditions until certain
17         conditions are met;
