5     (9)  The Agency for Health Care Administration shall create
6a Medicaid Disproportionate Share Council.
7     (a)  The purpose of the council is to study and make
8recommendations regarding:
9     1.  The formula for the regular disproportionate share
10program and alternative financing options.
11     2.  Enhanced Medicaid funding through the Special Medicaid
12Payment program.
13     3.  The federal status of the upper-payment-limit funding
14option and how this option may be used to promote health care
15initiatives determined by the council to be state health care
16priorities.
17     4.  The development of the low-income pool plan as required
18by the federal Centers for Medicare and Medicaid Services using
19the objectives established in s. 409.91211(1)(c).
20     (b)  The council shall include representatives of the
21Executive Office of the Governor and of the agency;
22representatives from teaching, public, private nonprofit,
23private for-profit, and family practice teaching hospitals; and
24representatives from other groups as needed. The agency must
25ensure that there is fair representation of each group specified
26in this paragraph.
27     (c)  The council shall submit its findings and
28recommendations to the Governor and the Legislature no later
29than March February 1 of each year.
30     (d)  This subsection shall stand repealed June 30, 2006,
31unless reviewed and saved from repeal through reenactment by the
32Legislature.
33     (10)  The Agency for Health Care Administration shall
34create a Medicaid Low-Income Pool Council by July 1, 2006. The
35Low-Income Pool Council shall consist of 17 members, including
36three representatives of statutory teaching hospitals, three
37representatives of public hospitals, three representatives of
38nonprofit hospitals, three representatives of for-profit
39hospitals, two representatives of rural hospitals, two
40representatives of units of local government which contribute
41funding, and one representative of family practice teaching
42hospitals. The council shall:
43     (a)  Make recommendations on the financing of the low-
44income pool and the disproportionate share hospital program and
45the distribution of their funds.
46     (b)  Advise the Agency for Health Care Administration on
47the development of the low-income pool plan required by the
48federal Centers for Medicare and Medicaid Services pursuant to
49the Medicaid reform waiver.
50     (c)  Advise the Agency for Health Care Administration on
51the distribution of hospital funds used to adjust inpatient
52hospital rates, rebase rates, or otherwise exempt hospitals from
53reimbursement limits as financed by intergovernmental transfers.
54     (d)  Submit its findings and recommendations to the
55Governor and the Legislature no later than February 1 of each
56year.
