11 The Committee on Ways and Means (Atwater) recommended the
12 following amendment:

14 Senate Amendment (with title amendment)
15 On page 43, between lines 11 and 12,
16
17 insert:
18 Section 7. An annual fee not to exceed $1,000,
19 established by the Division of Pari-mutuel Wagering, per slot
20 machine is imposed upon each slot machine approved for use at
21 any eligible facility as defined in s. 551.102, Florida
22 Statutes, which is within 1 mile of any neighboring
23 municipality. A "neighboring municipality" means a
24 municipality that does not have an eligible facility but is
25 adjacent to an eligible facility and will have public safety,
26 police, and fire-rescue impacts that are demonstrated by
27 significant increased aid calls to affected municipalities
28 that are currently not funded. Revenue from the fees imposed
29 by this section must be used by the neighboring municipality
30 to fund the adverse public health, safety, and welfare and
31 public works and traffic impacts that will be caused by the

1 implementation of Section 23, Article X of the State
2 Constitution and that will occur as a direct result of slot
3 machine operations. The annual fee must be remitted to the
4 Division of Pari-mutuel Wagering to be deposited into the
5 Pari-mutuel Wagering Trust Fund and distributed by the
6 division to any neighboring municipality that evidences to the
7 division annually such local impacts established by rules
8 adopted pursuant to s. 120.536(1) and s. 120.54, Florida
9 Statutes, which provide criteria for significant local
10 impacts, including increased crime incident reports,
11 fire-rescue and emergency medical incident reports, and
12 traffic flow and infrastructure impacts. The fee must be
13 remitted by February 1 of each year based on the number of
14 slot machines approved for operation by the division as of
15 January 1. The funds shall be designated by the division on a
16 pro rata basis to such affected neighboring municipalities.
