13         Senate Amendment (with title amendment) 
14         On page 37, line 5, through
15            page 39, line 6, delete those lines
16  
17  and insert:  
18         112.3215  Lobbying Lobbyists before the executive
19  branch, county officers, or the Constitution Revision
20  Commission; registration and reporting; investigation by
21  commission.--
22         (1)  For the purposes of this section:
23         (a)  "Agency" means the Governor, Governor and Cabinet,
24  or any department, division, bureau, board, commission, or
25  authority of the executive branch. In addition, "agency" shall
26  mean a county official and the Constitution Revision
27  Commission as provided by s. 2, Art. XI of the State
28  Constitution.
29         (b)  "Compensation" means a payment, distribution,
30  loan, advance, reimbursement, deposit, salary, fee, retainer,
31  or anything of value provided or owed to a lobbying firm,

Florida Senate - 2005 SENATOR AMENDMENT Bill No. SB 6-B Barcode 381822 1 directly or indirectly, by a principal. 2 (c) "County officers" means a sheriff, a tax 3 collector, a property appraiser, a supervisor of elections, or 4 a clerk of the circuit court. 5 (d)(b) "Expenditure" means a payment, distribution, 6 loan, advance, reimbursement, deposit, or anything of value 7 made by a lobbyist or principal for the purpose of lobbying. 8 (e)(c) "Fund" means the Executive Branch Lobby 9 Registration Trust Fund. 10 (f)1.(d) "Lobbies" means seeking, on behalf of another 11 person, to influence an agency with respect to a decision of 12 the agency in the area of policy or procurement or an attempt 13 to obtain the goodwill of an agency official or employee. 14 "Lobbies" also means influencing or attempting to influence, 15 on behalf of another, the Constitution Revision Commission's 16 action or nonaction through oral or written communication or 17 an attempt to obtain the goodwill of a member or employee of 18 the Constitution Revision Commission. 19 2. Food and beverages paid for or provided, directly 20 or indirectly, by a lobbyist or principal to, or for the 21 benefit of, an agency official or employee or a member or 22 employee of the Constitution Revision Commission is deemed an 23 attempt to obtain such person's goodwill unless the lobbyist 24 or principal is the person's parent, spouse, child, or 25 sibling. 26 (g) "Lobbying firm" means a business entity, including 27 an individual contract lobbyist, which receives or becomes 28 entitled to receive any compensation for the purpose of 29 lobbying, where any partner, owner, officer, or employee of 30 the business entity is a lobbyist. 31 (h)(e) "Lobbyist" means a person who is employed and 2 6:28 PM 12/05/05 s0006Bc-32-tl7
Florida Senate - 2005 SENATOR AMENDMENT Bill No. SB 6-B Barcode 381822 1 receives payment, or who contracts for economic consideration, 2 for the purpose of lobbying, or a person who is principally 3 employed for governmental affairs by another person or 4 governmental entity to lobby on behalf of that other person or 5 governmental entity. "Lobbyist" does not include a person who 6 is: 7 1. An attorney, or any person, who represents a client 8 in a judicial proceeding or in a formal administrative 9 proceeding conducted pursuant to chapter 120 or any other 10 formal hearing before an agency, board, commission, or 11 authority of this state. 12 2. An employee of an agency or of a legislative or 13 judicial branch entity acting in the normal course of his or 14 her duties. 15 3. A confidential informant who is providing, or 16 wishes to provide, confidential information to be used for law 17 enforcement purposes. 18 4. A person who lobbies to procure a contract pursuant 19 to chapter 287 which contract is less than the threshold for 20 CATEGORY ONE as provided in s. 287.017(1)(a). 21 (i)(f) "Principal" means the person, firm, 22 corporation, or other entity that which has employed or 23 retained a lobbyist. 24 25 26 ================ T I T L E A M E N D M E N T =============== 27 And the title is amended as follows: 28 On page 3, lines 27 through 29, delete those lines 29 30 and insert: 31 lobbyists before the executive branch, county 3 6:28 PM 12/05/05 s0006Bc-32-tl7
