16            page 23, line 25, delete those lines

18  and insert:  
19         112.3215  Lobbying Lobbyists before the executive
20  branch, county officers, or the Constitution Revision
21  Commission; registration and reporting; investigation by
22  commission.--
23         (1)  For the purposes of this section:
24         (a)  "Agency" means the Governor, Governor and Cabinet,
25  or any department, division, bureau, board, commission, or
26  authority of the executive branch. In addition, "agency" shall
27  mean a county official and the Constitution Revision
28  Commission as provided by s. 2, Art. XI of the State
29  Constitution.
30         (b)  "Compensation" means a payment, distribution,
31  loan, advance, reimbursement, deposit, salary, fee, retainer,

Florida Senate - 2005 SENATOR AMENDMENT Bill No. SB 6-B Barcode 691246 1 or anything of value provided or owed to a lobbying firm, 2 directly or indirectly, by a principal. 3 (c) "County officers" means a sheriff, a tax 4 collector, a property appraiser, a supervisor of elections, or 5 a clerk of the circuit court. 6 (d)(b) "Expenditure" means a payment, distribution, 7 loan, advance, reimbursement, deposit, or anything of value 8 made by a lobbyist or principal for the purpose of lobbying. 9 (e)(c) "Fund" means the Executive Branch Lobby 10 Registration Trust Fund. 11 (f)1.(d) "Lobbies" means seeking, on behalf of another 12 person, to influence an agency with respect to a decision of 13 the agency in the area of policy or procurement or an attempt 14 to obtain the goodwill of an agency official or employee. 15 "Lobbies" also means influencing or attempting to influence, 16 on behalf of another, the Constitution Revision Commission's 17 action or nonaction through oral or written communication or 18 an attempt to obtain the goodwill of a member or employee of 19 the Constitution Revision Commission. 20 2. Food and beverages paid for or provided, directly 21 or indirectly, by a lobbyist or principal to, or for the 22 benefit of, an agency official or employee or a member or 23 employee of the Constitution Revision Commission is deemed an 24 attempt to obtain such person's goodwill unless the lobbyist 25 or principal is the person's parent, spouse, child, or 26 sibling. 27 (g) "Lobbying firm" means a business entity, including 28 an individual contract lobbyist, which receives or becomes 29 entitled to receive any compensation for the purpose of 30 lobbying, if any partner, owner, officer, or employee of the 31 business entity is a lobbyist. 2 9:49 AM 12/08/05 s0006Bc-32-t02
Florida Senate - 2005 SENATOR AMENDMENT Bill No. SB 6-B Barcode 691246 1 (h)(e) "Lobbyist" means a person who is employed and 2 receives payment, or who contracts for economic consideration, 3 for the purpose of lobbying, or a person who is principally 4 employed for governmental affairs by another person or 5 governmental entity to lobby on behalf of that other person or 6 governmental entity. "Lobbyist" does not include a person who 7 is: 8 1. An attorney, or any person, who represents a client 9 in a judicial proceeding or in a formal administrative 10 proceeding conducted pursuant to chapter 120 or any other 11 formal hearing before an agency, board, commission, or 12 authority of this state. 13 2. An employee of an agency or of a legislative or 14 judicial branch entity acting in the normal course of his or 15 her duties. 16 3. A confidential informant who is providing, or 17 wishes to provide, confidential information to be used for law 18 enforcement purposes. 19 4. A person who lobbies to procure a contract pursuant 20 to chapter 287 which contract is less than the threshold for 21 CATEGORY ONE as provided in s. 287.017(1)(a). 22 (i)(f) "Principal" means the person, firm, 23 corporation, or other entity that which has employed or 24 retained a lobbyist. 25 26 27 ================ T I T L E A M E N D M E N T =============== 28 And the title is amended as follows: 29 On page 40, line 20, delete that line 30 31 and insert: 3 9:49 AM 12/08/05 s0006Bc-32-t02
