1 A bill to be entitled
2 An act relating to personnel discipline in
3 public schools; amending s. 1012.795, F.S.;
4 authorizing the Education Practices Commission
5 to penalize any person who knowingly obtained
6 or knowingly attempted to obtain an educator
7 certificate by fraudulent means; providing an
8 effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Paragraph (a) of subsection (1) of section
13 1012.795, Florida Statutes, is amended to read:
14 1012.795 Education Practices Commission; authority to
15 discipline.--
16 (1) The Education Practices Commission may suspend the
17 educator certificate of any person as defined in s. 1012.01(2)
18 or (3) for a period of time not to exceed 5 years, thereby
19 denying that person the right to teach or otherwise be
20 employed by a district school board or public school in any
21 capacity requiring direct contact with students for that
22 period of time, after which the holder may return to teaching
23 as provided in subsection (4); may revoke the educator
24 certificate of any person, thereby denying that person the
25 right to teach or otherwise be employed by a district school
26 board or public school in any capacity requiring direct
27 contact with students for a period of time not to exceed 10
28 years, with reinstatement subject to the provisions of
29 subsection (4); may revoke permanently the educator
30 certificate of any person thereby denying that person the
31 right to teach or otherwise be employed by a district school

1 board or public school in any capacity requiring direct
2 contact with students; may suspend the educator certificate,
3 upon order of the court, of any person found to have a
4 delinquent child support obligation; or may impose any other
5 penalty provided by law, provided it can be shown that the
6 person:
7 (a) Knowingly obtained or knowingly attempted to
8 obtain an educator certificate by fraudulent means.
9 Section 2. This act shall take effect upon becoming a
10 law.

14 Authorizes the Education Practices Commission to penalize
any person who knowingly obtained or knowingly attempted
15 to obtain an educator certificate by fraudulent means.
