1 A bill to be entitled
2 An act relating to personnel discipline in
3 public schools; amending s. 1012.795, F.S.;
4 authorizing the Education Practices Commission
5 to penalize any person who knowingly obtained
6 or knowingly attempted to obtain an educator
7 certificate by fraudulent means; providing for
8 prospective application of the act; providing
9 an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Paragraph (a) of subsection (1) of section
14 1012.795, Florida Statutes, is amended to read:
15 1012.795 Education Practices Commission; authority to
16 discipline.--
17 (1) The Education Practices Commission may suspend the
18 educator certificate of any person as defined in s. 1012.01(2)
19 or (3) for a period of time not to exceed 5 years, thereby
20 denying that person the right to teach or otherwise be
21 employed by a district school board or public school in any
22 capacity requiring direct contact with students for that
23 period of time, after which the holder may return to teaching
24 as provided in subsection (4); may revoke the educator
25 certificate of any person, thereby denying that person the
26 right to teach or otherwise be employed by a district school
27 board or public school in any capacity requiring direct
28 contact with students for a period of time not to exceed 10
29 years, with reinstatement subject to the provisions of
30 subsection (4); may revoke permanently the educator
31 certificate of any person thereby denying that person the

1 right to teach or otherwise be employed by a district school
2 board or public school in any capacity requiring direct
3 contact with students; may suspend the educator certificate,
4 upon order of the court, of any person found to have a
5 delinquent child support obligation; or may impose any other
6 penalty provided by law, provided it can be shown that the
7 person:
8 (a) Knowingly obtained or knowingly attempted to
9 obtain an educator certificate by fraudulent means.
10 Section 2. This act shall take effect upon becoming a
11 law and applies prospectively.
