A bill to be entitled
2An act relating to the carrying of firearms in national
3forests; repealing s. 790.11, F.S., which prohibits the
4carrying of firearms in national forests; repealing s.
5790.12, F.S., which authorizes the granting of a special
6permit for the carrying of firearms in a national forest;
7repealing s. 790.14, F.S., which provides a penalty for
8violation of ss. 790.11 and 790.12, F.S.; amending s.
9790.25, F.S.; correcting cross-references; directing the
10Department of Environmental Protection to amend the
11correlative rule in the Florida Administrative Code, to
12conform; providing an effective date.

14Be It Enacted by the Legislature of the State of Florida:

16     Section 1.  Sections 790.11, 790.12, and 790.14, Florida
17Statutes, are repealed.
18     Section 2.  Paragraph (b) of subsection (2) of section
19790.25, Florida Statutes, is amended to read:
20     790.25  Lawful ownership, possession, and use of firearms
21and other weapons.--
22     (2)  USES NOT AUTHORIZED.--
23     (b)  The protections of this section do not apply to the
24following:
25     1.  A person who has been adjudged mentally incompetent,
26who is addicted to the use of narcotics or any similar drug, or
27who is a habitual or chronic alcoholic, or a person using
28weapons or firearms in violation of ss. 790.07-790.115 790.07-
29790.12, 790.145-790.19 790.14-790.19, 790.22-790.24;
30     2.  Vagrants and other undesirable persons as defined in s.
31856.02;
32     3.  A person in or about a place of nuisance as defined in
33s. 823.05, unless such person is there for law enforcement or
34some other lawful purpose.
35     Section 3.  The Department of Environmental Protection is
36directed to adopt amendments to rule 62D-2.014(10), Florida
37Administrative Code, to repeal the provision that no person
38shall use, carry, or possess firearms in state parks.
39     Section 4.  This act shall take effect October 1, 2006.
