7An act relating to the carrying of firearms in national
8forests; repealing s. 790.11, F.S., which prohibits the
9carrying of firearms in national forests; repealing s.
10790.12, F.S., which authorizes the granting of a special
11permit for the carrying of firearms in a national forest;
12repealing s. 790.14, F.S., which provides a penalty for
13violation of ss. 790.11 and 790.12, F.S.; amending s.
14790.25, F.S.; correcting cross-references; requiring the
15Department of Environmental Protection to amend the
16correlative rule in the Florida Administrative Code to
17allow the possession of weapons in compliance with all
18Florida Statutes; providing requirements with respect to
19amendment of the rule; providing an effective date.

21Be It Enacted by the Legislature of the State of Florida:
22
23     Section 1.  Sections 790.11, 790.12, and 790.14, Florida
24Statutes, are repealed.
25     Section 2.  Paragraph (b) of subsection (2) of section
26790.25, Florida Statutes, is amended to read:
27     790.25  Lawful ownership, possession, and use of firearms
28and other weapons.--
29     (2)  USES NOT AUTHORIZED.--
30     (b)  The protections of this section do not apply to the
31following:
32     1.  A person who has been adjudged mentally incompetent,
33who is addicted to the use of narcotics or any similar drug, or
34who is a habitual or chronic alcoholic, or a person using
35weapons or firearms in violation of ss. 790.07-790.115 790.07-
36790.12, 790.145-790.19 790.14-790.19, 790.22-790.24;
37     2.  Vagrants and other undesirable persons as defined in s.
38856.02;
39     3.  A person in or about a place of nuisance as defined in
40s. 823.05, unless such person is there for law enforcement or
41some other lawful purpose.
42     Section 3.  The Department of Environmental Protection
43shall amend rule 62D-2.014(10), Florida Administrative Code, to
44allow the possession of weapons in compliance with all
45applicable Florida Statutes. The rule shall be amended to
46indicate that such weapons shall be at all times in the
47possession of a responsible party or properly secured within or
48to a vehicle or temporary housing, which shall include motor
49homes, travel trailers, recreational vehicles, campers, tents,
50or other enclosed structures, while in state parks.
51     Section 4.  This act shall take effect October 1, 2006.
