11 | permit for the carrying of firearms in a national forest; |
12 | repealing s. 790.14, F.S., which provides a penalty for |
13 | violation of ss. 790.11 and 790.12, F.S.; amending s. |
14 | 790.25, F.S.; correcting cross-references; requiring the |
15 | Department of Environmental Protection to amend the |
16 | correlative rule in the Florida Administrative Code to |
17 | allow the possession of weapons in compliance with all |
18 | Florida Statutes; providing requirements with respect to |
19 | amendment of the rule; providing an effective date. |

21 | Be It Enacted by the Legislature of the State of Florida: |
22 |
|
23 | Section 1. Sections 790.11, 790.12, and 790.14, Florida |
24 | Statutes, are repealed. |
25 | Section 2. Paragraph (b) of subsection (2) of section |
26 | 790.25, Florida Statutes, is amended to read: |
27 | 790.25 Lawful ownership, possession, and use of firearms |
28 | and other weapons.-- |
29 | (2) USES NOT AUTHORIZED.-- |
30 | (b) The protections of this section do not apply to the |
31 | following: |
32 | 1. A person who has been adjudged mentally incompetent, |
33 | who is addicted to the use of narcotics or any similar drug, or |
34 | who is a habitual or chronic alcoholic, or a person using |
35 | weapons or firearms in violation of ss. 790.07-790.115 790.07- |
36 | 790.12, 790.145-790.19 790.14-790.19, 790.22-790.24; |
37 | 2. Vagrants and other undesirable persons as defined in s. |
38 | 856.02; |
39 | 3. A person in or about a place of nuisance as defined in |
40 | s. 823.05, unless such person is there for law enforcement or |
41 | some other lawful purpose. |
42 | Section 3. The Department of Environmental Protection |
43 | shall amend rule 62D-2.014(10), Florida Administrative Code, to |
44 | allow the possession of weapons in compliance with all |
45 | applicable Florida Statutes. The rule shall be amended to |
46 | indicate that such weapons shall be at all times in the |
47 | possession of a responsible party or properly secured within or |
48 | to a vehicle or temporary housing, which shall include motor |
49 | homes, travel trailers, recreational vehicles, campers, tents, |
50 | or other enclosed structures, while in state parks. |
51 | Section 4. This act shall take effect October 1, 2006. |
