A bill to be entitled
2An act relating to the carrying of firearms in national
3forests; repealing s. 790.11, F.S., which prohibits the
4carrying of firearms in national forests; repealing s.
5790.12, F.S., which authorizes the granting of a special
6permit for the carrying of firearms in a national forest;
7repealing s. 790.14, F.S., which provides a penalty for
8violation of ss. 790.11 and 790.12, F.S.; amending s.
9790.25, F.S.; correcting cross-references; requiring the
10Department of Environmental Protection to amend the
11correlative rule in the Florida Administrative Code to
12allow the possession of weapons in compliance with all
13Florida Statutes; providing requirements with respect to
14amendment of the rule; providing an effective date.

16Be It Enacted by the Legislature of the State of Florida:

18     Section 1.  Sections 790.11, 790.12, and 790.14, Florida
19Statutes, are repealed.
20     Section 2.  Paragraph (b) of subsection (2) of section
21790.25, Florida Statutes, is amended to read:
22     790.25  Lawful ownership, possession, and use of firearms
23and other weapons.--
24     (2)  USES NOT AUTHORIZED.--
25     (b)  The protections of this section do not apply to the
26following:
27     1.  A person who has been adjudged mentally incompetent,
28who is addicted to the use of narcotics or any similar drug, or
29who is a habitual or chronic alcoholic, or a person using
30weapons or firearms in violation of ss. 790.07-790.115 790.07-
31790.12, 790.145-790.19 790.14-790.19, 790.22-790.24;
32     2.  Vagrants and other undesirable persons as defined in s.
33856.02;
34     3.  A person in or about a place of nuisance as defined in
35s. 823.05, unless such person is there for law enforcement or
36some other lawful purpose.
37     Section 3.  The Department of Environmental Protection
38shall amend rule 62D-2.014(10), Florida Administrative Code, to
39allow the possession of weapons in compliance with all
40applicable Florida Statutes. The rule shall be amended to
41indicate that such weapons shall be at all times in the
42possession of a responsible party or properly secured within or
43to a vehicle or temporary housing, which shall include motor
44homes, travel trailers, recreational vehicles, campers, tents,
45or other enclosed structures, while in state parks.
46     Section 4.  This act shall take effect October 1, 2006.
