| 2 | An act relating to pawnbroking; amending s. 539.001, F.S.;  | 
| 3 | providing that local ordinances may not require the  | 
| 4 | payment of any fee related to a pawn transaction unless  | 
| 5 | authorized under the Florida Pawnbroking Act; providing an  | 
| 6 | effective date. |

| 8 | Be It Enacted by the Legislature of the State of Florida: | 
| 9 | 
  | 
| 10 |      Section 1.  Subsection (20) of section 539.001, Florida  | 
| 11 | Statutes, is amended to read: | 
| 12 |      539.001  The Florida Pawnbroking Act.-- | 
| 13 |      (20)  CONFLICTING ORDINANCES.--Any county or municipality  | 
| 14 | may enact ordinances that are in compliance with, but not more  | 
| 15 | restrictive than this section, except that local ordinances may  | 
| 16 | not require the payment of any fee related to a pawn transaction  | 
| 17 | unless authorized in this chapter or restrict hours of  | 
| 18 | operations other than between midnight and 6 a.m. Any ordinance  | 
| 19 | that conflicts with this subsection is void. Nothing in This  | 
| 20 | section does not shall affect the authority of a county or  | 
| 21 | municipality to establish land use controls or require a  | 
| 22 | pawnbroker to obtain a local occupational license. | 
| 23 |      Section 2.  This act shall take effect July 1, 2006. |
