| 8 | providing that local ordinances shall not require the |
| 9 | payment of any fee or tax related to a pawn transaction or |
| 10 | purchase unless authorized under the Florida Pawnbroking |
| 11 | Act; providing an effective date. |

| 13 | Be It Enacted by the Legislature of the State of Florida: |
| 14 |

| 15 | Section 1. Subsection (20) of section 539.001, Florida |
| 16 | Statutes, is amended to read: |
| 17 | 539.001 The Florida Pawnbroking Act.-- |
| 18 | (20) CONFLICTING ORDINANCES.--Any county or municipality |
| 19 | may enact ordinances that are in compliance with, but not more |
| 20 | restrictive than this section, except that local ordinances |
| 21 | shall may not require the payment of any fee or tax related to a |
| 22 | pawn transaction or purchase unless authorized under this |
| 23 | chapter or restrict hours of operations other than between |
| 24 | midnight and 6 a.m. Any ordinance that conflicts with this |
| 25 | subsection is void. Nothing in This section does not shall |
| 26 | affect the authority of a county or municipality to establish |
| 27 | land use controls or require a pawnbroker to obtain a local |
| 28 | occupational license. |
| 29 | Section 2. This act shall take effect July 1, 2006. |
