7An act relating to pawnbroking; amending s. 539.001, F.S.;
8providing that local ordinances shall not require the
9payment of any fee or tax related to a pawn transaction or
10purchase unless authorized under the Florida Pawnbroking
11Act; providing an effective date.

13Be It Enacted by the Legislature of the State of Florida:
14
15     Section 1.  Subsection (20) of section 539.001, Florida
16Statutes, is amended to read:
17     539.001  The Florida Pawnbroking Act.--
18     (20)  CONFLICTING ORDINANCES.--Any county or municipality
19may enact ordinances that are in compliance with, but not more
20restrictive than this section, except that local ordinances
21shall may not require the payment of any fee or tax related to a
22pawn transaction or purchase unless authorized under this
23chapter or restrict hours of operations other than between
24midnight and 6 a.m. Any ordinance that conflicts with this
25subsection is void. Nothing in This section does not shall
26affect the authority of a county or municipality to establish
27land use controls or require a pawnbroker to obtain a local
28occupational license.
29     Section 2.  This act shall take effect July 1, 2006.
