2An act relating to the Northern Palm Beach County
3Improvement District, Palm Beach County; amending chapter
42000-467, Laws of Florida, as amended; requiring prior
5written notice of candidacy to be eligible for election to
6the Board of Supervisors; providing an effective date.

8Be It Enacted by the Legislature of the State of Florida:

10     Section 1.  Section 6 of section 3 of chapter 2000-467,
11Laws of Florida, as amended by chapter 2005-302, Laws of
12Florida, is amended to read:
13     Section 6.  Meetings of landowners; elections.--
14     (A)  Each year during the month of November, beginning with
15the month of November 2006, a meeting of the landowners of the
16District shall be held for the purpose of electing Supervisors
17and hearing reports of the Board of Supervisors; provided,
18however, that a meeting of the landowners shall be held during
19the month of November 2005, for the purpose of receiving reports
20of the Board of Supervisors and considering any matters upon
21which the Board of Supervisors may request the advice and views
22of the landowners. The Board of Supervisors shall have the power
23to call special meetings of the landowners at any time to
24receive reports of the Board of Supervisors or consider and act
25upon any matter upon which the Board of Supervisors may request
26advice. Notice of all meetings of the landowners shall be given
27by the Board of Supervisors by causing publication thereof to be
28made for 2 consecutive weeks prior to such meeting in some
29newspaper published in Palm Beach County. The meetings of the
30landowners shall be held in some public place in said County,
31and the place, day, and hour of holding such meetings shall be
32stated in the notice. The landowners when assembled shall
33organize by electing a Chair who shall preside at the meeting.
34The Secretary of the Board of Supervisors shall be the Secretary
35of such meeting. At all such meetings each and every acre, or
36any fraction thereof, of land in the District, except publicly
37owned property against which the District does not levy
38assessments, shall represent one share, and each owner shall be
39entitled to one vote in person or by written proxy for every
40acre, or any fraction thereof, of land owned by him or her in
41the District. The person receiving the highest number of votes
42for Supervisor shall be declared and elected as such Supervisor.
43Those landowners present or voting by proxy shall constitute a
44quorum at any meeting of the landowners.
45     (B)  Guardians may represent their wards, and personal
46representatives may represent the estates of deceased persons.
47Trustees may represent lands held by them in trust, and private
48and municipal corporations may be represented by their officers
49or duly authorized agents. Guardians, personal representatives,
50trustees, and corporations may vote by proxy.
51     (C)  To be eligible for election pursuant to this section,
52a candidate for the office of Supervisor shall file a written
53notice of intention to be a candidate in the office of the
54District at least 30 days before the annual meeting of the
55landowners.
56     Section 2.  This act shall take effect upon becoming a law.
