  1                      A bill to be entitled

  2         An act relating to DUI programs; amending s.

  3         322.292, F.S.; requiring that DUI classes be

  4         taught by a certified instructor in a classroom

  5         in which the instructor and offenders in the

  6         class are physically present; prohibiting any

  7         other method of instruction; providing an

  8         effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11  

12         Section 1.  Subsection (4) is added to section 322.292,

13  Florida Statutes, to read:

14         322.292  DUI programs supervision; powers and duties of

15  the department.--

16         (4)  DUI education courses must be conducted by a

17  certified DUI instructor in a classroom using face-to-face

18  instruction and must provide for interaction in the classroom

19  among offenders and the instructor. Courses may not be

20  conducted via the Internet, remote electronic technology, home

21  study, distance learning, or any other method in which the

22  instructor and offenders are not physically present in the

23  same classroom.

24         Section 2.  This act shall take effect July 1, 2006.
