18 Section 2. Subsection (3) of section 373.324, Florida
19 Statutes, is amended, and subsection (7) is added to that
20 section, to read:
21 373.324 License renewal.--
22 (3) The department shall prescribe by rule the method
23 for renewal of a license, which shall include continuing
24 education requirements of not less than 12 classroom hours for
25 each renewal cycle. In addition to the fees provided in s.
26 373.329, the department by rule shall establish a fee not to
27 exceed $20 per credit hour to be paid by the licensee for the
28 cost of implementing the continuing education requirements of
29 this subsection. The fee shall be based on the actual costs
30 incurred in administering the responsibilities related to the
31 continuing education requirements. The department may delegate

1 to the water management districts, or the department or a
2 water management district may contract with a private entity
3 to carry out, the responsibilities related to the continuing
4 education requirements. However, if a water well contractor
5 has received his or her first license within 180 days before
6 the end of the license biennium, the continuing education
7 requirements shall be waived for the licensee's first renewal
8 cycle.
9 (7) Notwithstanding the renewal requirements of
10 subsection (3) and the provision under s. 250.4815, any active
11 water well contractor license issued under this part to a
12 servicemember as defined in s. 250.01 or his or her spouse,
13 both of whom reside in the state, shall not become inactive
14 while the servicemember is serving on military orders that
15 take him or her over 35 miles from his or her residence, and
16 the license shall be considered an active license for up to
17 180 days after the servicemember returns to his or her
18 residence in the state. If the license renewal requirements
19 are met within the 180-day extension period, the servicemember
20 or his or her spouse shall not be charged any additional costs
21 above the normal license fees, including, but not limited to,
22 late fees or delinquency fees. Nothing in this subsection
23 shall be construed to waive renewal requirements such as
24 applying, continuing education, and all associated fees. The
25 servicemember must present to the water management district
26 issuing the license a copy of his or her official military
27 orders or a written verification from the servicemember's
28 commanding officer before the end of the 180-day period in
29 order to qualify for the extension.
