A bill to be entitled
2An act relating to slot machine licenses; creating the
3"Equal Treatment Under the Law Act"; amending s. 551.104,
4F.S.; revising requirements for issuance or renewal of a
5slot machine license; requiring the applicant to have on
6file certain agreements with the Florida Standardbred
7Breeders and Owners Association, the Florida Greyhound
8Association, Inc., and the International Jai Alai Players
9Association which govern the payment of purses and awards;
10providing an effective date.

12Be It Enacted by the Legislature of the State of Florida:

14     Section 1.  This act may be cited as the "Equal Treatment
15Under the Law Act."
16     Section 2.  Paragraph (a) of subsection (10) of section
17551.104, Florida Statutes, as created by chapter 2005-362, Laws
18of Florida, is amended to read:
19     551.104  License to conduct slot machine gaming.--
20     (10)(a)  No slot machine license or renewal thereof shall
21be issued to an applicant holding a permit under chapter 550 to
22conduct pari-mutuel wagering meets of thoroughbred racing unless
23the applicant has on file with the division a binding written
24agreement between the applicant and the Florida Horsemen's
25Benevolent and Protective Association, Inc., the Florida
26Standardbred Breeders and Owners Association, the Florida
27Greyhound Association, Inc., and the International Jai Alai
28Players Association governing the payment of purses and awards
29on live thoroughbred races or games conducted at the licensee's
30pari-mutuel facility. In addition, no slot machine license or
31renewal thereof shall be issued to such an applicant unless the
32applicant has on file with the division a binding written
33agreement between the applicant and the Florida Thoroughbred
34Breeders' Association, Inc., governing the payment of breeders',
35stallion, and special racing awards on live thoroughbred races
36conducted at the licensee's pari-mutuel facility, and the
37Florida Standardbred Breeders and Owners Association, the
38Florida Greyhound Association, Inc., and the International Jai
39Alai Players Association governing the payment of purses and
40awards on live races or games conducted at the licensee's pari-
41mutuel facility. The agreement governing purses and the
42agreement governing awards may direct the payment of such purses
43and awards from revenues generated by any wagering or gaming the
44applicant is authorized to conduct under Florida law. All purses
45and awards shall be subject to the terms of chapter 550. All
46sums for breeders', stallion, and special racing awards shall be
47remitted monthly to the Florida Thoroughbred Breeders'
48Association, Inc., for the payment of awards subject to the
49administrative fee authorized in s. 550.2625(3).
50     Section 3.  This act shall take effect July 1, 2006.
