6An act relating to slot machine licenses; creating the
7"Equal Treatment Under the Law Act"; amending s. 551.104,
8F.S.; revising requirements for issuance or renewal of a
9slot machine license; requiring the applicant to have on
10file certain agreements with the Florida Standardbred
11Breeders and Owners Association, the Florida Greyhound
12Association, Inc., and the International Jai Alai Players
13Association which govern the payment of purses and awards;
14providing for payment of breeders', stallion, and special
15racing awards on standardbred races to specified entity;
16providing an effective date.

18Be It Enacted by the Legislature of the State of Florida:

20     Section 1.  This act may be cited as the "Equal Treatment
21Under the Law Act."
22     Section 2.  Paragraph (a) of subsection (10) of section
23551.104, Florida Statutes, as created by chapter 2005-362, Laws
24of Florida, is amended to read:
25     551.104  License to conduct slot machine gaming.--
26     (10)(a)  No slot machine license or renewal thereof shall
27be issued to an applicant holding a permit under chapter 550 to
28conduct pari-mutuel wagering meets of thoroughbred racing unless
29the applicant has on file with the division a binding written
30agreement between the applicant and the Florida Horsemen's
31Benevolent and Protective Association, Inc., the Florida
32Standardbred Breeders and Owners Association, the Florida
33Greyhound Association, Inc., or the International Jai Alai
34Players Association governing the payment of purses or jai alai
35player awards on live thoroughbred races or games conducted at
36the licensee's pari-mutuel facility. In addition, no slot
37machine license or renewal thereof shall be issued to such an
38applicant unless the applicant has on file with the division a
39binding written agreement between the applicant and the Florida
40Thoroughbred Breeders' Association, Inc., or the Florida
41Standardbred Breeders and Owners Association, as applicable,
42governing the payment of breeders', stallion, and special racing
43awards on live horse thoroughbred races conducted at the
44licensee's pari-mutuel facility. The agreement governing purses,
45the agreement governing jai alai player awards, and the
46agreement governing breeders', stallion, and special racing
47awards may direct the payment of such purses and awards from
48revenues generated by any wagering or gaming the applicant is
49authorized to conduct under Florida law. All purses and awards
50shall be subject to the terms of chapter 550. All sums for
51breeders', stallion, and special racing awards shall be remitted
52monthly to the Florida Thoroughbred Breeders' Association, Inc.,
53or the Florida Standardbred Breeders and Owners Association, for
54the payment of awards subject to the administrative fee
55authorized in s. 550.2625(3) or (4), as applicable.
56     Section 3.  This act shall take effect July 1, 2006.
