11  Senator Bennett moved the following amendment:

13         Senate Amendment (with title amendment) 
14         On page 1, line 22, through
15            page 3, line 5, delete those lines
16  
17  and insert:  
18         Section 1.  Section 125.022, Florida Statutes, is
19  created to read:
20         125.022  Development permits.--When a county denies an
21  application for a development permit, the county shall give
22  written notice to the applicant. The notice must include a
23  citation to the applicable portions of an ordinance, rule,
24  statute, or other legal authority for the denial of the
25  permit. As used in this section, the term "development permit"
26  has the same meaning as in s. 163.3164.
27         Section 2.  Section 166.033, Florida Statutes, is
28  created to read:
29         166.033  Development permits.--When a municipality
30  denies an application for a development permit, the
31  municipality shall give written notice to the applicant. The

 1  notice must include a citation to the applicable portions of
 2  an ordinance, rule, statute, or other legal authority for the
 3  denial of the permit. As used in this section, the term
 4  "development permit" has the same meaning as in s. 163.3164.
 5         Section 3.  This act shall take effect October 1, 2006.

10         On page 1, lines 2-18, delete those lines

12  and insert:
13         An act relating to the denial of development
14         permits; creating s. 125.022, F.S.; requiring a
15         county to give written notice of its decision
16         to deny a development permit; specifying
17         information that the notice must include;
18         defining the term "development permit";
19         creating s. 166.033, F.S.; requiring a
20         municipality to give written notice of its
21         decision to deny a development permit;
22         specifying information that the notice must
23         include; providing an effective date.
