  2         An act relating to the denial of development

  3         permits; creating s. 125.022, F.S.; requiring a

  4         county to give written notice of its decision

  5         to deny a development permit; specifying

  6         information that the notice must include;

  7         defining the term "development permit";

  8         creating s. 166.033, F.S.; requiring a

  9         municipality to give written notice of its

10         decision to deny a development permit;

11         specifying information that the notice must

12         include; providing an effective date.

14  Be It Enacted by the Legislature of the State of Florida:

15  

16         Section 1.  Section 125.022, Florida Statutes, is

17  created to read:

18         125.022  Development permits.--When a county denies an

19  application for a development permit, the county shall give

20  written notice to the applicant. The notice must include a

21  citation to the applicable portions of an ordinance, rule,

22  statute, or other legal authority for the denial of the

23  permit. As used in this section, the term "development permit"

24  has the same meaning as in s. 163.3164.

25         Section 2.  Section 166.033, Florida Statutes, is

26  created to read:

27         166.033  Development permits.--When a municipality

28  denies an application for a development permit, the

29  municipality shall give written notice to the applicant. The

30  notice must include a citation to the applicable portions of

31  an ordinance, rule, statute, or other legal authority for the

 1  denial of the permit. As used in this section, the term

 2  "development permit" has the same meaning as in s. 163.3164.
