  1                      A bill to be entitled

  2         An act relating to medical practice; creating

  3         s. 458.3094, F.S.; requiring the Board of

  4         Medicine to adopt rules requiring physician

  5         training in cultural competency; specifying

  6         rules related to required training for students

  7         in colleges of medicine in this state and for

  8         physicians licensed in this state; providing

  9         exceptions; providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12  

13         Section 1.  Section 458.3094, Florida Statutes, is

14  created to read:

15         458.3094  Requirements for training in cultural

16  competency.--

17         (1)  The Board of Medicine shall adopt rules for

18  physician training in cultural competency which include the

19  following requirements:

20         (a)  The curriculum in each college of medicine in this

21  state must include instruction in cultural competency which is

22  designed to address race and gender-based disparities in

23  medical treatment decisions. The rules shall be developed in

24  consultation with the Association of American Medical Colleges

25  or another nationally recognized organization that reviews

26  medical school curricula.

27         (b)  A medical student must complete training in

28  cultural competency before he or she may receive a diploma

29  from a college of medicine in this state.

30         (c)  A college of medicine that provides instruction in

31  cultural competency must also offer cultural competency

 1  training as continuing medical education. The training may be

 2  provided through classroom instruction, workshops, or other

 3  educational programs sponsored by the college which meet

 4  criteria established by the board.

 5         (d)  A physician licensed to practice medicine in this

 6  state who has not completed instruction in cultural competency

 7  as part of a medical school curriculum must, as a condition of

 8  relicensure, complete training in cultural competency which is

 9  offered pursuant to this section by July 1, 2009.

10         (2)  The board may waive the educational requirements

11  of this section if an applicant for relicensure demonstrates

12  that he or she has received the substantial equivalent of this

13  requirement through completion of a similar course in

14  postsecondary education which meets criteria established by

15  the board.

16         Section 2.  This act shall take effect July 1, 2006.
