6An act relating to the practice of architecture and
7interior design; amending s. 481.203, F.S.; defining
8"responsible supervising control"; amending s. 481.205,
9F.S.; authorizing the Board of Architecture and Interior
10Design to adopt certain rules relating to responsible
11supervising control; amending s. 481.223, F.S.;
12authorizing certain architects to use the title
13"Architect, Retired" and certain interior designers to use
14the title "Interior Designer, Retired"; providing an
15effective date.

17Be It Enacted by the Legislature of the State of Florida:
18
19     Section 1.  Subsection (16) is added to section 481.203,
20Florida Statutes, to read:
21     481.203  Definitions.--As used in this part:
22     (16)  "Responsible supervising control" means the exercise
23of direct personal supervision and control throughout the
24preparation of documents, instruments of service, or any other
25work requiring the seal and signature of a person licensed under
26this part.
27     Section 2.  Subsection (4) is added to section 481.205,
28Florida Statutes, to read:
29     481.205  Board of Architecture and Interior Design.--
30     (4)  The board may establish by rule minimum procedures,
31documentation, and other requirements for indicating evidence of
32the exercise of responsible supervising control by a person
33licensed under this part in connection with work performed both
34inside and outside the licensee's office.
35     Section 3.  Subsection (1) of section 481.223, Florida
36Statutes, is amended to read:
37     481.223  Prohibitions; penalties; injunctive relief.--
38     (1)  A person may not knowingly:
39     (a)  Practice architecture unless the person is an
40architect or a registered architect; however, an architect who
41has been licensed by the board and who chooses to relinquish or
42not to renew his or her license may use the title "Architect,
43Retired" but may not otherwise render any architectural
44services;
45     (b)  Practice interior design unless the person is a
46registered interior designer unless otherwise exempted herein;
47however, an interior designer who has been licensed by the board
48and who chooses to relinquish or not to renew his or her license
49may use the title "Interior Designer, Retired" but may not
50otherwise render any interior design services;
51     (c)  Use the name or title "architect" or "registered
52architect," or "interior designer" or "registered interior
53designer," or words to that effect, when the person is not then
54the holder of a valid license issued pursuant to this part;
55     (d)  Present as his or her own the license of another;
56     (e)  Give false or forged evidence to the board or a member
57thereof;
58     (f)  Use or attempt to use an architect or interior
59designer license that has been suspended, revoked, or placed on
60inactive or delinquent status;
61     (g)  Employ unlicensed persons to practice architecture or
62interior design; or
63     (h)  Conceal information relative to violations of this
64part.
65     Section 4.  This act shall take effect July 1, 2006.
