1 A bill to be entitled
2 An act relating to immunizations; amending s.
3 381.005, F.S.; requiring certain assisted
4 living facilities to offer immunizations
5 against influenza viruses and pneumococcal
6 bacteria to residents age 65 or older;
7 requiring the Department of Health or its
8 designee to notify assisted living facilities
9 by a specified date of the facilities'
10 responsibilities; amending s. 1003.22, F.S.;
11 requiring each district school board and the
12 governing authority of each private school to
13 provide information concerning meningococcal
14 disease and its vaccine to parents; requiring
15 the Department of Health to adopt rules
16 specifying the age or grade level of students
17 for whom such information will be provided;
18 requiring each district school board and the
19 governing authority of each private school to
20 determine the means and method for the
21 provision of information regarding
22 meningococcal disease to parents; providing an
23 effective date.

25 Be It Enacted by the Legislature of the State of Florida:
26
27 Section 1. Present subsection (3) of section 381.005,
28 Florida Statutes, is redesignated as subsection (4), and a new
29 subsection (3) is added to that section, to read:
30 381.005 Primary and preventive health services.--

1 (3) Between October 1 of each year, or earlier if the
2 vaccination is available, and February 1 of the following
3 year, subject to the availability of an adequate supply of the
4 necessary vaccine, each assisted living facility licensed
5 under chapter 400 which has 11 or more licensed beds shall
6 implement a program to offer immunizations against influenza
7 viruses and pneumococcal bacteria to all residents who are age
8 65 or older, in accordance with the recommendations of the
9 Advisory Committee on Immunization Practices of the United
10 States Centers for Disease Control and Prevention and subject
11 to the clinical judgment of the responsible practitioner. By
12 September 1 of each year, the department or its designee shall
13 send to each assisted living facility covered by this section
14 a reminder notice of the responsibilities of each assisted
15 living facility under this section.
16 Section 2. Subsection (10) of section 1003.22, Florida
17 Statutes, is amended to read:
18 1003.22 School-entry health examinations; immunization
19 against communicable diseases; exemptions; duties of
20 Department of Health.--
21 (10) Each district school board and the governing
22 authority of each private school shall:
23 (a) Refuse admittance to any child otherwise entitled
24 to admittance to kindergarten, or any other initial entrance
25 into a Florida public or private school, who is not in
26 compliance with the provisions of subsection (4).
27 (b) Temporarily exclude from attendance any student
28 who is not in compliance with the provisions of subsection
29 (4).
30 (c) Provide detailed information concerning the
31 causes, symptoms, and transmission of meningococcal disease;

1 the risks associated with meningococcal disease; and the
2 availability, effectiveness, and known contraindications of
3 any required or recommended vaccine against meningococcal
4 disease to every student's parent, in accordance with the
5 recommended ages of students determined by the Department of
6 Health to be appropriate for the administration of such
7 vaccine. The Department of Health shall adopt rules that
8 specify the age or grade level of students for whom such
9 information shall be provided, consistent with the
10 recommendations of the Advisory Committee on Immunization
11 Practices of the United States Centers for Disease Control and
12 Prevention concerning the appropriate age for the
13 administration of the vaccine, and shall make available to
14 school districts and the governing authorities of each private
15 school information concerning the causes, symptoms, and
16 transmission of meningococcal disease; the risks associated
17 with meningococcal disease; and the availability,
18 effectiveness, and known contraindications of any required or
19 recommended vaccine. Each district school board and the
20 governing authority of each private school shall determine the
21 means and methods for the provision of such information to
22 students' parents.
23 Section 3. This act shall take effect July 1, 2006.
