5 | Section 2. Paragraph (b) of subsection (4) of section |
6 | 121.091, Florida Statutes, is amended to read: |
7 | 121.091 Benefits payable under the system.--Benefits may |
8 | not be paid under this section unless the member has terminated |
9 | employment as provided in s. 121.021(39)(a) or begun |
10 | participation in the Deferred Retirement Option Program as |
11 | provided in subsection (13), and a proper application has been |
12 | filed in the manner prescribed by the department. The department |
13 | may cancel an application for retirement benefits when the |
14 | member or beneficiary fails to timely provide the information |
15 | and documents required by this chapter and the department's |
16 | rules. The department shall adopt rules establishing procedures |
17 | for application for retirement benefits and for the cancellation |
18 | of such application when the required information or documents |
19 | are not received. |
20 | (4) DISABILITY RETIREMENT BENEFIT.-- |
21 | (b) Total and permanent disability.-- |
22 | 1. Except as provided in subparagraph 2., a member shall |
23 | be considered totally and permanently disabled if, in the |
24 | opinion of the administrator, he or she is prevented, by reason |
25 | of a medically determinable physical or mental impairment, from |
26 | rendering useful and efficient service as an officer or |
27 | employee. |
28 | 2. A member of the Special Risk Class who is a law |
29 | enforcement officer, firefighter, correctional officer, |
30 | emergency medical technician, paramedic as described in s. |
31 | 121.021(15)(c), community-based correctional probation officer |
32 | as described in s. 121.021(15)(d)1., or nurse as described in s. |
33 | 121.0515(2)(f), shall be considered shall be considered totally |
34 | and permanently disabled in the line of duty if he or she is |
35 | prevented, by reason of a medically determinable physical or |
36 | mental impairment caused by a job-related injury, from |
37 | performing useful and efficient service in the position held, |
38 | unless the administrator can provide competent medical evidence |
39 | to the contrary. |
