| 8 | Be It Enacted by the Legislature of the State of Florida: |
| 9 |

| 10 | Section 1. Section 794.075, Florida Statutes, is created |
| 11 | to read: |
| 12 | 794.075 Sexual predators; erectile dysfunction drugs.-- |
| 13 | (1) A person may not possess a prescription drug, as |
| 14 | defined in s. 499.003(25), for the purpose of treating erectile |
| 15 | dysfunction if the person is designated as a sexual predator |
| 16 | under s. 775.21. |
| 17 | (2) A person who violates a provision of this section for |
| 18 | the first time commits a misdemeanor of the second degree, |
| 19 | punishable as provided in s. 775.082 or s. 775.083. A person who |
| 20 | violates a provision of this section a second or subsequent time |
| 21 | commits a misdemeanor of the first degree, punishable as |
| 22 | provided in s. 775.082 or s. 775.083. |
| 23 | Section 2. This act shall take effect October 1, 2006. |
