A bill to be entitled
2An act relating to travel expenses; amending s. 112.061,
3F.S.; establishing mileage rates for travel expenses for
4certain correctional probation officers; providing an
5effective date.

7Be It Enacted by the Legislature of the State of Florida:

9     Section 1.  Paragraph (d) of subsection (7) of section
10112.061, Florida Statutes, is amended to read:
11     112.061  Per diem and travel expenses of public officers,
12employees, and authorized persons.--
13     (7)  TRANSPORTATION.--
14     (d)1.  The use of privately owned vehicles for official
15travel in lieu of publicly owned vehicles or common carriers may
16be authorized by the agency head or his or her designee.
17Whenever travel is by privately owned vehicle, the traveler
18shall be entitled to a mileage allowance at a fixed rate of 25
19cents per mile for state fiscal year 1994-1995 and 29 cents per
20mile thereafter or the common carrier fare for such travel, as
21determined by the agency head. Reimbursement for expenditures
22related to the operation, maintenance, and ownership of a
23vehicle shall not be allowed when privately owned vehicles are
24used on public business and reimbursement is made pursuant to
25this paragraph, except as provided in subsection (8).
26Notwithstanding any other provisions of this subparagraph, when
27travel is by privately owned vehicle and the traveler is a
28correctional probation officer, as defined in s. 943.10(3), who
29is engaged in a law enforcement or correctional duty, the
30officer shall be entitled to the mileage allowance equal to the
31business standard mileage rate as set by the Internal Revenue
32Service for the calendar year in which the official travel
33occurs.
34     2.  All mileage shall be shown from point of origin to
35point of destination and, when possible, shall be computed on
36the basis of the current map of the Department of
37Transportation. Vicinity mileage necessary for the conduct of
38official business is allowable but must be shown as a separate
39item on the expense voucher.
40     Section 2.  This act shall take effect July 1, 2006.
