7 | Be It Enacted by the Legislature of the State of Florida: |

9 | Section 1. Paragraph (d) of subsection (7) of section |
10 | 112.061, Florida Statutes, is amended to read: |
11 | 112.061 Per diem and travel expenses of public officers, |
12 | employees, and authorized persons.-- |
13 | (7) TRANSPORTATION.-- |
14 | (d)1. The use of privately owned vehicles for official |
15 | travel in lieu of publicly owned vehicles or common carriers may |
16 | be authorized by the agency head or his or her designee. |
17 | Whenever travel is by privately owned vehicle, the traveler |
18 | shall be entitled to a mileage allowance at a fixed rate of 25 |
19 | cents per mile for state fiscal year 1994-1995 and 29 cents per |
20 | mile thereafter or the common carrier fare for such travel, as |
21 | determined by the agency head. Reimbursement for expenditures |
22 | related to the operation, maintenance, and ownership of a |
23 | vehicle shall not be allowed when privately owned vehicles are |
24 | used on public business and reimbursement is made pursuant to |
25 | this paragraph, except as provided in subsection (8). |
26 | Notwithstanding any other provisions of this subparagraph, when |
27 | travel is by privately owned vehicle and the traveler is a |
28 | correctional probation officer, as defined in s. 943.10(3), who |
29 | is engaged in a law enforcement or correctional duty, the |
30 | officer shall be entitled to the mileage allowance equal to the |
31 | business standard mileage rate as set by the Internal Revenue |
32 | Service for the calendar year in which the official travel |
33 | occurs. |
34 | 2. All mileage shall be shown from point of origin to |
35 | point of destination and, when possible, shall be computed on |
36 | the basis of the current map of the Department of |
37 | Transportation. Vicinity mileage necessary for the conduct of |
38 | official business is allowable but must be shown as a separate |
39 | item on the expense voucher. |
40 | Section 2. This act shall take effect July 1, 2006. |
