3     Amendment (with title amendment)
4     Between lines 336 and 337, insert:
5     Section 8.  Paragraph (b) of subsection (1) of section
6633.022, Florida Statutes, is amended to read:
7     633.022  Uniform firesafety standards.--The Legislature
8hereby determines that to protect the public health, safety, and
9welfare it is necessary to provide for firesafety standards
10governing the construction and utilization of certain buildings
11and structures. The Legislature further determines that certain
12buildings or structures, due to their specialized use or to the
13special characteristics of the person utilizing or occupying
14these buildings or structures, should be subject to firesafety
15standards reflecting these special needs as may be appropriate.
16     (1)  The department shall establish uniform firesafety
17standards that apply to:
18     (b)  All new, existing, and proposed hospitals, nursing
19homes, assisted living facilities, adult family-care homes,
20correctional facilities, public schools, transient public
21lodging establishments, except for facilities operated by
22religious organizations working in conjunction with the Family
23Promise program, public food service establishments, elevators,
24migrant labor camps, mobile home parks, lodging parks,
25recreational vehicle parks, recreational camps, residential and
26nonresidential child care facilities, facilities for the
27developmentally disabled, motion picture and television special
28effects productions, and self-service gasoline stations, of
29which standards the State Fire Marshal is the final
30administrative interpreting authority.

32In the event there is a dispute between the owners of the
33buildings specified in paragraph (b) and a local authority
34requiring a more stringent uniform firesafety standard for
35sprinkler systems, the State Fire Marshal shall be the final
36administrative interpreting authority and the State Fire
37Marshal's interpretation regarding the uniform firesafety
38standards shall be considered final agency action.

41     Remove line 32 and insert:
42for certain purposes; amending s. 633.022, F.S.; providing an
43exemption to the application of certain uniform firesafety
44standards; providing effective dates.
