  1                      A bill to be entitled

  2         An act relating to the sale or lease of a

  3         county, district, or municipal hospital;

  4         amending s. 155.40, F.S.; clarifying

  5         construction with respect to actions of a

  6         lessee or purchaser; providing an effective

  7         date.

  9  Be It Enacted by the Legislature of the State of Florida:

10  

11         Section 1.  Subsection (7) of section 155.40, Florida

12  Statutes, is amended to read:

13         155.40  Sale or lease of county, district, or municipal

14  hospital.--

15         (7)  The lessee or purchaser of a hospital, pursuant to

16  this section or any special act of the Legislature, operating

17  under a lease shall not be construed to be "acting on behalf

18  of" the lessor or seller as that term is used in statute,

19  unless the lease or purchase document expressly provides to

20  the contrary.

21         Section 2.  This act shall take effect July 1, 2006.
