A bill to be entitled
2An act relating to telecommunication rates; repealing ss.
3364.059, 364.164, and 364.051(6), (7), and (8), F.S.,
4relating to price regulation and competitive market
5enhancements of local exchange telecommunication
6companies; providing that any local telecommunications
7service rate that was increased and any corresponding
8telecommunications intrastate access fee that was reduced
9by action of the Florida Public Service Commission but
10that has not yet been implemented is null and void;
11providing that if a local telecommunications service rate
12was increased and a corresponding telecommunications
13intrastate access fee was reduced, those rates and fees
14are suspended as of a specified date, and thereafter a
15local exchange telecommunications company must charge
16local service rates and intrastate access fees at the
17rates in effect on December 1, 2003; providing an
18effective date.

20Be It Enacted by the Legislature of the State of Florida:

22     Section 1.  Sections 364.059 and 364.164, and subsections
23(6), (7), and (8) of s. 364.051, Florida Statutes, are repealed.
24     Section 2.  (1)  Any local service rate that was increased
25and any corresponding intrastate access fee that was reduced by
26action of the Florida Public Service Commission under former s.
27364.164, Florida Statutes, but that has not yet been implemented
28because the rate increase has been stayed pending appellate
29review, is null and void as if never granted by the commission.
30     (2)  Any local service rate that was increased and any
31corresponding intrastate access fee that was reduced by action
32of the commission under former s. 364.164, Florida Statutes, and
33that has been implemented after appellate review, is suspended
34as of the effective date of this act. Thereafter, a local
35exchange telecommunications company must charge local service
36rates and intrastate access fees at the rate in effect on
37December 1, 2003.
38     Section 3.  This act shall take effect May 15, 2006, or
39upon becoming a law, whichever occurs later.
