15 Delete everything after the enacting clause

17 and insert:
18 Section 1. Section 287.1346, Florida Statutes, is
19 created to read:
20 287.1346 Contractual access and use of electronic and
21 information technology for persons with disabilities; rules.--
22 (1) Any private contractor that contracts with an
23 agency to sell commodities or services to the state shall
24 comply with the provisions of sections 504 and 508 of the
25 Rehabilitation Act of 1973, as amended, 29 U.S.C. s. 794(d),
26 and with the Americans with Disabilities Act. Each contract
27 entered into between an agency and a private contractor must
28 contain a requirement that the private contractor comply with
29 the provisions of section 508 of the Rehabilitation Act of
30 1973, as amended, 29 U.S.C. s. 794(d). Failure by a private
31 contractor to comply with such provisions shall be considered

1 a breach of the contract and constitutes grounds for
2 revocation of the contract.
3 (2) Each state agency shall comply with the provisions
4 of sections 504 and 508 of the Rehabilitation Act of 1973, as
5 amended, 29 U.S.C. s. 794(d), and with the Americans with
6 Disabilities Act, when contracting to purchase commodities or
7 services and when conducting any agency activities relating to
8 access and use of electronic information and technology.
9 (3) Pursuant to chapter 120, the department shall
10 adopt any rules necessary to administer, implement, and
11 enforce this section.
12 Section 2. This act shall take effect July 1, 2006.
