2 An act relating to contractual access and use
3 of electronic and information technology for
4 persons with disabilities; creating s.
5 287.1346, F.S.; requiring contractors to comply
6 with certain federally mandated Internet
7 accessibility requirements for persons with
8 disabilities; specifying contract requirements;
9 specifying conditions for breach and
10 termination of a contract; requiring state
11 agencies to comply with such federal
12 requirements under certain circumstances;
13 requiring the Department of Management Services
14 to adopt rules; providing an effective date.

16 Be It Enacted by the Legislature of the State of Florida:

18 Section 1. Section 287.1346, Florida Statutes, is
19 created to read:
20 287.1346 Contractual access and use of electronic and
21 information technology for persons with disabilities; rules.--
22 (1) Any private contractor which contracts with an
23 agency to sell commodities or services to the state shall
24 comply with the provisions of section 508 of the
25 Rehabilitation Act of 1973, as amended, 29 U.S.C. s. 794(d).
26 Each contract entered into between an agency and a private
27 contractor must contain a requirement that the private
28 contractor comply with the provisions of section 508 of the
29 Rehabilitation Act of 1973, as amended, 29 U.S.C. s. 794(d).
30 Failure by a private contractor to comply with such provisions

1 shall be considered a breach of the contract and constitutes
2 grounds for revocation of the contract.
3 (2) Each state agency shall comply with the provisions
4 of section 508 of the Rehabilitation Act of 1973, as amended,
5 29 U.S.C. s. 794(d), when contracting to purchase commodities
6 or services and when conducting any agency activities relating
7 to access and use of electronic information and technology.
8 (3) Pursuant to chapter 120, the department shall
9 adopt any rules necessary to administer, implement, and
10 enforce this section.
11 Section 2. This act shall take effect July 1, 2006.
