1 A bill to be entitled
2 An act relating to health care; amending ss.
3 458.331 and 459.015, F.S.; requiring the Board
4 of Medicine and the Board of Osteopathic
5 Medicine to establish by rule certain standards
6 of practice and standards of care for
7 physicians and osteopathic physicians who
8 supervise licensed health care practitioners
9 who are not under direct, onsite supervision by
10 the supervising physician; providing an
11 effective date.

13 Be It Enacted by the Legislature of the State of Florida:
14
15 Section 1. Paragraph (dd) of subsection (1) of section
16 458.331, Florida Statutes, is amended to read:
17 458.331 Grounds for disciplinary action; action by the
18 board and department.--
19 (1) The following acts constitute grounds for denial
20 of a license or disciplinary action, as specified in s.
21 456.072(2):
22 (dd) Failing to supervise adequately the activities of
23 those physician assistants, paramedics, emergency medical
24 technicians, advanced registered nurse practitioners, or
25 anesthesiologist assistants acting under the supervision of
26 the physician. Notwithstanding any other provision of this
27 chapter, the board shall establish by rule standards of
28 practice and standards of care for physicians who supervise
29 licensed health care practitioners who are not under direct,
30 onsite supervision of the supervising physician. The standards
31 established in the rules may vary depending on the specialty

1 of the physician, the type of licensed health care
2 practitioner under supervision, and the practice setting. The
3 rules must include, but need not be limited to, the percentage
4 of time the supervising physician spends directly supervising
5 the licensed health care practitioners; standards for adequate
6 supervision, including the distance of the licensed health
7 care practitioner from the supervising physician; and the
8 number of each type of licensed health care practitioner which
9 a supervising physician may supervise.
10 Section 2. Paragraph (hh) of subsection (1) of section
11 459.015, Florida Statutes, is amended to read:
12 459.015 Grounds for disciplinary action; action by the
13 board and department.--
14 (1) The following acts constitute grounds for denial
15 of a license or disciplinary action, as specified in s.
16 456.072(2):
17 (hh) Failing to supervise adequately the activities of
18 those physician assistants, paramedics, emergency medical
19 technicians, advanced registered nurse practitioners,
20 anesthesiologist assistants, or other persons acting under the
21 supervision of the osteopathic physician. Notwithstanding any
22 other provision of this chapter, the board shall establish by
23 rule standards of practice and standards of care for
24 osteopathic physicians who supervise licensed health care
25 practitioners who are not under direct, onsite supervision of
26 the supervising osteopathic physician. The standards
27 established in the rules may vary depending on the specialty
28 of the physician, the type of licensed health care
29 practitioner under supervision, and the practice setting. The
30 rules must include, but need not be limited to, the percentage
31 of time the supervising osteopathic physician spends directly

2 for adequate supervision, including the distance of the

7 Section 3. This act shall take effect upon becoming a
8 law.
