A bill to be entitled
2An act relating to reckless driving; amending s. 316.192,
3F.S.; revising the acts that constitute reckless driving;
4specifying certain acts that constitute reckless driving
5per se; providing an effective date.

7Be It Enacted by the Legislature of the State of Florida:

9     Section 1.  Subsection (1) of section 316.192, Florida
10Statutes, is amended to read:
11     316.192  Reckless driving.--
12     (1)(a)  Any person who drives any vehicle in willful or
13wanton disregard for the safety of persons or property, or at a
14speed or in a manner that is likely to endanger any person or
15property, is guilty of reckless driving.
16     (b)  The following acts constitute reckless driving per se:
17     1.  Driving 20 miles per hour or more in excess of the
18posted speed limit that contributes to an accident that results
19in property damage, personal injury, or death;
20     2.  Driving 25 miles per hour or more in excess of the
21posted speed limit;
22     3.  Driving 90 miles per hour or more regardless of the
23posted speed limit; or
24     4.  Fleeing a law enforcement officer.
25     Section 2.  This act shall take effect July 1, 2006.
