1 A bill to be entitled
2 An act relating to Indian gaming activities;
3 designating the Governor as the official to
4 negotiate tribal-state compacts; providing for
5 ratification of tribal-state compacts by the
6 Legislature; providing for submission of the
7 tribal-state compact to the Legislature and
8 Secretary of State; providing for submission of
9 the tribal-state compact to the Secretary of
10 the Interior; providing an effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. (1) The Governor is the designated state
15 officer responsible for negotiating and executing, on behalf
16 of the state, tribal-state gaming compacts with federally
17 recognized Indian tribes located within the State of Florida
18 pursuant to the federal Indian Gaming Regulatory Act of 1988,
19 18 U.S.C. ss. 1166-1168, and 25 U.S.C. s. 2701 et seq., for
20 the purpose of authorizing class III gaming, as defined in
21 that act, on Indian lands within this state.
22 (2) Any tribal-state compact relating to gaming
23 activities which is entered into by an Indian tribe in this
24 state and the Governor pursuant to subsection (1) must be
25 conditioned upon ratification by the Legislature.
26 (3) Following completion of negotiations, the Governor
27 shall submit a copy of any executed tribal-state compact for
28 ratification by a majority vote by both houses of the
29 Legislature and shall submit a copy of the executed
30 tribal-state compact to the Secretary of State pending receipt

1 of an act ratifying the tribal-state compact under the
2 provisions of this section.
3 (4) Upon receipt of an act ratifying the tribal-state
4 compact, the Secretary of State shall forward a copy of the
5 executed tribal-state compact and the ratifying act to the
6 United States Secretary of the Interior for his or her review
7 and approval, in accordance with 25 U.S.C. s. 2710(8)(d).
8 Section 2. This act shall take effect upon becoming a
9 law.
