  1                      A bill to be entitled

  2         An act relating to child care facilities;

  3         amending s. 402.305, F.S.; providing that

  4         employment screening for good moral character

  5         is valid for 1 year; requiring child care

  6         personnel to be rescreened using level 2

  7         standards for screening; requiring child care

  8         personnel to be rescreened if the person has a

  9         break in his or her employment in the child

10         care industry for more than 90 days; providing

11         an effective date.

13  Be It Enacted by the Legislature of the State of Florida:

14  

15         Section 1.  Paragraph (a) of subsection (2) of section

16  402.305, Florida Statutes, is amended to read:

17         402.305  Licensing standards; child care facilities.--

18         (2)  PERSONNEL.--Minimum standards for child care

19  personnel shall include minimum requirements as to:

20         (a)  Good moral character based upon screening.  This

21  screening shall be conducted as provided in chapter 435, using

22  the level 2 standards for screening set forth in that chapter.

23  A screening conducted under this paragraph is valid for 1

24  year, at which time a rescreening of the person must be

25  conducted using the level 2 standards for screening. In

26  addition, child care personnel must be rescreened following a

27  break in employment in the child care industry of longer than

28  90 days.

29         Section 2.  This act shall take effect July 1, 2006.
